He should pay for his crimes, but he is subject right or wrong to the UCMJ as a soldier and not Afghanistan law. from a legal pov.
This awful situation really raises a lot of questions about the way the military has been 'recycling' troops.

As much as I hate this infamous war, its not this soldiers fault. Yes he was a dick for killing so many children but put yourself in his shoes for a second. The war has been going on for 10 fckin years and no victory, no accomplishment, no good news. These poor soldiers are paying day and night. Who knows how many friends he lost in the war. He was in his 4th tour. Never ever send a soldier back to the same place more than twice. Its these politicians and these 4 star generals that decide the fate of these poor soldiers from the luxury of their air conditioned offices in pentagon and white house. US govt really needs to look after its troops because theyll be coming home soon and we dont want psychos roaming around. Just 2 days ago, a cali based soldier killed his 11 years old sister before killing himself. I have seen a man dying myself and I still think of it and i feel like throwing up. Imagine, what these men have seen.
BTW: I dont agree with people that say Oh its a fckin war, get over it. Thats not a right thing to say. It can happen to you too. Also, killing this soldier wont solve the problem. You guys need to work on this soldier and learn the psychology of this man so we can treat others like him because I promise you, there are ****load of others like him in US and in AFG.

He should be tried by the military under the UCMJ. I do not condone his actions but people need to put themselves in the boots of these soldiers being recycled for a 4th, or 5th time. This dude had a brain injury suffered in Iraq, watched his friends being killed and maimed all around him by people who strap explosives to women and children and detonate them in crowded markets full of, you guessed it, civilians, and struggled to keep his family together. He has two kids, a 3 and 4 year old. Tell me now, if that was your dad, brother, cousin, friend, ect. would you be calling for his head? Would you want him to be thrown to the wolves? Purposeful killing of innocent civilians is horrible, and should be punished, but if you all want to get your panties in a twist about abuses of human rights, theres several other battles you should be picking...
