the question is about intent, not actual crime. Trump didn't have to actually commit the other crime, nor does the DA have to show that he did.

They just have to show he had intention of aiding or concealing the other crime. Cohen's guilty plea could be sign that Trump knew of the other crime, which would support a conclusion that he had the intention of aiding or concealing it when he falsied the records
