The living will is while you are still alive but not in capacity.
Since you are derailing eomrats serious post on a serious topic... We're going to update your living will to gift your banding pliers to your goats and a container of bands and give them full permission to settle historic wrongs they may have suffered

My Mom is incapacitated and suffering so I told my daughter that I do NOT want to be in this state.

I have assets, so there is a family trust. It includes a will but also protects assets.
