So here's how it kinda works. WNB and Andy can probably elaborate on the legal side a bit more.

Theoretically a movie company either adds itself as a public tracker or pays a third party for this service. All they are doing is representing a host for a distributed database of who has th file in question or who wants the file in question.
This information of-course includes a IP address, current progress/completion of the file's download and if the IP in question as a host has uploaded or distributed the file.
The download of the file is NOT illegal. Torrenting files is NOT illegal.
Watching a file that doesn't adhere to copyright laws IS illegal. Uploading and therefore distributing the file without express rights from the copyright holder's permission IS illegal.

BUT without admission or definitive proof you are innocent until proven guilty.
To prove you guilty of downloading a file, the logs of IP addresses is looked at, and ISP's will be requested to give information.
Problem here is that IPs for the most part of 90% of consumers are dynamically allocated from a pool that each ISP is given, so effectively all they can do is suggest or assume the download may have been you. But it could have been logged off a user into the past. Let's assume that the ISP also keeps a log however of when and how long you maintained the IP that has been logged, well chit. does that make definitive proof? Well no. Did you watch the file? Did you share the file? Can they prove you actually downloaded the file and it wasn't an unauthorized individual on your network?

edit; plus they have too much of a hard time getting international websites to co-operate with legal requests. ".se" and ".to" which I'm sure someone frequenting various torrent files might recognize are registered in Sweden and Tonga respectively. But other safehavens such as ".so" are used.

I used to be a massive pirate but I guess I've sort of outgrown it, I just can't be bothered with all the downloading and burning discs and storing on hard drives etc. Part of it is definitely that we used to be poor so pirating was the best option, not so poor these days plus we prefer to have the nice shiny blurays/dvds on the shelf, it makes it easier when picking out something to watch.

Legit copies are also MUCH cheaper than they used to be! Games for instance, I remember when Super Nintendo titles were about $110 and that was for ANY game and DVD movies and music CD's were over $30 each! Prices of today are much more palatable which is another reason I pirate no more.

Go to any asian country, $2-3 a pop for top quality dvd's. Customs doesn't take them off you when you come back through. Strong everything, my countrymen are doing it right. Slow friday night in newcastle, really starting to hate this place. Especially after the lad bashing in charlestown

I work for one of the ISP's in the article and I'm pretty confident most people will be fine. I think the picture corporations are just trying to scare people into stop torrenting as it is pretty rampant in Australia. But now that we're finally getting some decently priced streaming options, it'll start to taper off anyway.
