By law, if the waiter/delivery guy does not make more than minimum wage with low salary and tips the employer has to make up the difference by law.

So even if you do not tip you delivery guy, he WILL get minimum wage. Wounder why people do not talk about this more often? Because all those whiny goobys /always/
make more than minimum wage in 99% of the cases.

You are wrong about employer not paying the difference... in NYC they will be ****ED. Lawyers take those cases pro-bono or even free since such news are a big deal (Saigon Grill in NYC for example got ton's of media attention)

They don't is the thing. If you can't make minimum wage in a tip oriented industry it's your own damn fault. My GF waited tables all through college and would average $25+ an hour, but it was understood that if you're not making tips to cover minimum wage then it was your responsibility to work harder. Infact she didn't even get the $2 an hour or whatever
