Story time misc -
Last year I was renting a nice condo from a couple for $1795/mo, and put down a deposit for $2000.
Over the course of renting with them I threw many parties, and even had the cops visit my place on 18 different times. The landlord threatened to evict, I cleaned up my behavior and threw less parties. Needless to say my landlords and I did not get along very well after that, which leads me to believe they made the decisions they made because of personal vindication against me.
2 weeks after I move I'm expecting my deposit back since no damage was done by myself for the time was there and nothing.
Finally after 3 weeks I receive a bill titled "holdback + pending charges" with an amount due of $1700
I decide to call an ask my landlords about it, no answer. I send an email out, saying we did a walkout (which I never recieved a copy of), and the things listed on the bill were not done by me. No answer. I decide to patiently wait for an answer.
I find in the mail one month later that I am being sued for the amount owed and to call a listed number for any questions I might have. I call and find out that they hired a property manager to go through with the move out process (which I didn't agree to, therefore not legal) and them saying I signed off on the damage that was listed. I thought to myself, wtfuark? I didn't sign chit. I asked for the court date, and hung up.
I look up the state statute on the laws of returning a deposit and it states if the landlord breaks any of the listed laws, that I can sue up to 3x the deposit + any associated fees.
With this new found information I send what you call a demand letter, asking for the return of my normal deposit ($2000) and if they dont send me a check within 15 business days, I would countersue for $12,000 (deposit x3 + filing costs + damages)
She told me to go ahead.
I attempt to file a claim, and my claim gets returned. Why? She fuarking claimed active duty because she was a JAG Attorney in another state. This bish was so cheeky.
I proceed to sue her husband instead.
******Today was my court date for this mess*******
Their argument comes up that I signed off on the damages. I go to take a look at wtf they are talking about. They forged my signature.
I told the judge that it was forgery, and showed her plenty of evidence that I had brought with my real signature to court.
Judge sentence proceeded and they owed me $12,000 and a process to have her law license diminished.
Cliffs:
- Rented a lot of condo
- Had a lot of parties
- Bad relationship with Landlord
- Refused to return my deposit
- Gave her a chance
- She forged my signature
- Got a lot of money back + she lost her job. feels good mane

That's screwed up that they would try to "steal" your deposit but I am glad you took them to court and won your deposit plus "damages".

Sounds like they should have had a property manager in the first place to boot your ass out for disturbing the peace and refusing others quiet enjoyment. Overall they fuked up the whole process in the end which is the only reason you won.
And this my friends, is why if you invest in income property is why you hire a property manager who knows the rules and regulations in the first place.

Neighbors like that always suck. If she would have went through a property manager they would have known it was a troublesome neighbor and wrote it off as bullchit complaints.
Either way, this is why you get property managers. (Good ones,) are the in between for the owner and the tenant and keep everyone happy.
