Eh. Based on what I've seen so far you seem to be pretty fair and you don't get off on being a douchenozzle. I've seen some other mods around in the past that have just made me shake me head.

The same thing that is unclear about whether something is a copyright violation anywhere? Usual defenses to copyright violations.
This is a moot point but I'm always up for conversation.
1. PMs aren't lumped in there expressly. I notice that "private messages" are not expressly on that list. "[I]nstant messaging" is, whatever that is.
2. You can make the argument that PMs should be included as "a feature offered as part of any Site that offers the opportunity for users to . . ."
3. There is a difference between disclaiming responsibility for accidental "leaks" (i.e. no guarantee of security) and affirmatively reading messages and communications. The rest of that rule supports the reading as the former. For example, the ToS does say: "we cannot guarantee the security of any information", "you make such disclosures at your own risk", "we have no duty to monitor any Forum", "you . . . remain solely responsible for the Submissions", etc. It does not say, "we can monitor your messages", "we will investigate your messages". In fact, it suggests the opposite.
4. While this is not a constitutional matter, as you correctly pointed out, when the Constitution has been applied the courts have drawn a distinction when the party [i.e. government or public school] expressly stated that the user should not expect privacy because messages can be searched upon certain conditions/reasonable suspicion, etc., or that communications can be monitored. The BB.com ToS mentions neither. Again, because the ToS is written to protect BB.com from accidental disclosure, not to allow BB.com to read private messages.
Cliffs:
BB.com ToS is a shield, not a sword. And since (according to you) the mods cannot read private messages, it would appear that the BB.com ToS agrees with me.
Also: I'm not arguing with anyone. I never argue.
Hmm... that makes me curious how you were directed here in the first place.
Since, presumably, if I send a PM of myself naked to... let's say, you and you appreciate it (as you would be believe me ) there would be no reason for anyone to report either myself or you since, while the rule is being broken, no one is affected by it.

no i havent. not in months. ill do shurgs once and awhile with 450-500 lbs using straps. but i have horrible grip strength I can do seated rows with 300 lbs for 12-15 reps for 5 sets. (clean not sloppy), so it not like i dont have decent back strength, i just can keep a tight grip on the bar.
been focusing on my legs pretty hard. quads are starting to really make progress. doing 405 for a 5x5. ATG. like my ass is damn near on my heels.†Misc Car Crew†

I've been a mod before, its not all that its cracked up to be. You see a lot of annoyances, mostly people reporting retarded **** with the most whiny comments, and PM's of people bitching and crying about anything and everything, every action you take or do results in people pissed off and calling for your head. It really is a thankless job, I cant imagine trying to manage the beast that is the misc. Reps alone would not be worth it to myself.

No, but I do have access to an abundance of common sense.
Common sense tells me that if mods can't read private messages, the issue of whether or not the ToS allows mods to read private messages has never come up. Or if it has come up, it came down against mods being able to do so.
Can you find a flaw in that reasoning? Hint: There isn't one. I'm not 100% certain, so I'll backtrack on that one, but that at least gets me to 99%.
I'm equally certain that the Supreme Court has has never heard a case on whether the government should be permitted to conduct research on rocks playing the electric violin. For the same reason.
Mod forum?
I suppose if you tell me that in your "mod forum" someone told you that "yeah the ToS lets mods read private messages BUT mods can't actually do it because that's not a feature" I'll take your word for it. Just pointing out as part of a separate and unrelated discussion that the BB.com ToS is silent on the issue of mods reading private messages because, as VAPump was kind enough to point out, mods cannot read private messages. Which is a good thing. Because they're private.
