zimmerman sighing when she read the possible guilty verdict was hard to watch, Can't imagine what he is feeling right now.

I saw that too. When she read "we the jury find george zimmerman guilty of 2nd degree murder" it definitely hit home for him. I can't imagine being in that seat. I would be scared to death after some of the things the judge pulled. isthisreallife never applied more.

A judge is not allowed to enter a JNOV of "guilty" following a jury acquittal in United States criminal cases because it would violate a defendant's Sixth Amendment right to a trial by jury. However, if the judge grants a motion to set aside judgment after the jury convicts, this may be reversed on appeal by the prosecution, as the verdict was different previously.

For the intents and purposes of this trial, if this jury comes back with a verdict of not guilty, this judge will not be able to overrule them. That is what the original poster was questioning.

GZ didn't need to be in fear for his life before he got out of the car. He didn't need to be in fear of his life when TM came out of the dark. He didn't need to be in fear of his life when the altercation started.

He needed to have a fear of serious bodily injury or death right before he pulled the trigger.

There is no evidence that GZ stalked TM...and if GZ was looking around with a flashlight, guess what? that is legal. What happened when TM and GZ came into contact is only known by GZ at this point. Without EVIDENCE stating anything different, we have to take his word for it. that's called law.

Once again, the misc shows its true colors.. A forum full of racists. I find it appalling that someone would HOPE a man who kills a teenager would go free, and also speak ill of a dead person you know nothing about.

Whether Trayvon had 12 kilos of pure coke, and marijuana filled pockets, it is irrelevant, zimmerman never met or had any contact with trayvon before. Hell, TM could have just been on his way back from robbing a bank, but its entirely irrelevant.


If I am in fear for my life, I would drive the other direction, and not leave my car, maybe I'm just weird? One simple action-- Zimmerman not leaving his car and we would never know Zimmerman or Martin even existed.

Logically, who is more likely to be the aggressor? 17 year old kid with skittles and drink in hand, or grown man, history of beating women, calls 911 for open garages and slow moving vehicles, and oh yeah-- he has a gun?

Getting out of your car is not an act of aggression and does not endanger someone's life. Beating the **** out of someone does endanger their life.

It has nothing to do with race.

If the jury finds the defendant guilty, the judge can throw out the verdict and pronounce the defendant "not guilty" or order a new trial.

However, a judge can't find a defendant guilty if the jury found them not guilty.

The original poster's question was whether or not a judge can overrule the jury if they acquit, and find them guilty by decree. Obviously they can't.

They have to take a decent amount of time to get back there, settle, pick a forewoman, and even begin to go over their instructions. See if everybody is on the same page. Look at evidence that they haven't had an opportunity to just yet (evidence introduced that wasn't really argued in trial), etc.

Fail. Your comments about 'fear for life' is irrelevant. George wasnt in fear for his life when he was reporting Trayvon as a 'suspicious person' to police, AND NO ONE CLAIMED THAT. He wasnt in fear for his life until Trayvon was violently assaulting him over and over and over as he was screaming for help.

Doing neighborhood watch, trying to find out where a 'suspicious person' went does NOT make anyone an 'aggressor.'
