Buchele says it didn't happen that way. He describes an encounter which looked and sounded like the officer shooting a person a point blank range, not because he feared for his life, but because the woman did not obey his order to stop rolling up the window.
"He was right next to the vehicle. He had one hand on the door handle and one hand on his weapon. And she was rolling the window up. And they were exiting out of the parkng lot.
The window was half way up he said 'stop or I'll shoot.' I really didn't think he was going to do it. But she got the window all the way up and that's when he shot. And then she took a left out of the parking lot here and he stepped out in the street and fired five more times," said Buchele.
Buchele says the officer was not dragged and that he shot her before she drove away. He says he didn't have his arm caught because the officer's left hand was on the door handle and right hand was holding a weapon. Also, he says he distinctly saw her roll up the window all the way before the officer shot out the glass and killed her.
edit: wasn't a checkpoint. She was 'suspicious' in a parking lot and rolled up the window upon questioning.

There a lot of stupid in this incident on both sides obviously, so you're right. "Don't run from cops" is a pretty general rule that obviously she should have followed. "Don't shoot unarmed innocent people" is the rule that, if you break it, you should probably get the needle or go to jail for a long time.

Don't know if she panic or the cop over reacted in this case. Or both. Nice gentle people can panic and do stupid things at the wrong place at the wrong time.
If you try to hit the cop with your car, the car is considered a dangerous weapon and use of lethal force is justifiable, eventhough you are not armed with a gun/knife/bomb. The manner you are trying to drive away, even if you only mean to get away and not mean to run the cop down, can get you shot. It has happened. Justifiable use of force. A moving car is considered a dangerous weapon.

edit: read a little closer and it's a "he said, she said" kind of thing. If the cop was lying to cover his ass, then **** him as hard you can. If he has a clean record and is objective on police matters like most everyone in this post so far I'm sure there will be no problems with his eyewitness testimony
