- so I sometimes smoke herb In my condo ( was being discrete as possible ) I Own it
- I guess one of my neighbors complained . Months ago there was a few notices on my floor reminding that smoking is not allowed
- I ignored the warning
- then yesterday the condo Manger left me a voice mail saying " I have a couple questions about about unit please call me back"
- I ignored him and never called back figuring nothing good could come from that
- if he really accusing me ill say produce legitimate proof . I'm not admitting to anything. I'm not legally obligated to return return his call. And def not going to as he doesn't even go into the reason of the call trying to bait me into calling him back but I know what it's about
- I just find it stupid they make mj in Canada completely legal and I can't smoke it in a condo that I privately own . Where do they expect you to go ?
- they may as well say no cooking either because the smell might linger around the building
- it's not like I'm blowing it in the hall way 24/7 I'm trying to be as courtesiest as possible

If smoking is not allowed it doesn't matter what you smoke whether it's cigarettes, weed, or vape pens no matter how discrete you're trying to be. Just because you paid and own the condo doesn't release you from following the property guidelines. We own our house but we live within the area of our homeowners association. We're free to do what we want, but if people complain, then we really don't have a choice. Either go buy your own house or move somewhere with less restrictions.

I hate you and youre a poosy.
But your one out could be: It wasn't smoking weed, its just the aroma of flower, which is perfectly legal and within guidelines.
Unless they physically see you smoking they cant prove much.
My building is similar. "no smoking policy" but given it could be any of the units on the floor and or just the aroma of flower they cant really pinpoint it.
Although we have a built in clause that says anyone who owns before 2017 can smoke all they want whatever they want so hard to enforce.
But also, yes, HOA does whatever they want they're huge ****s.

Here's a thought. My friend lives in an apartment where he isn't allowed to smoke. He walks out to the sidewalk off of property and smokes right in front of the landlords unit, super passive aggressive behavior. The sidewalk is private property, so they can't tell him chit.
Do this, walk outside to the side walk, off of your property onto public property, smoke there. Walk all around your neighborhood, on the side walk and street smoking and spreading obnoxious maryjauna smoke all over the neighborhood. HOA regulation, as far as I know, don't extend to public property. Though I don't know you live in Canada so maybe HOAs have more power thereKnow Justice

Probably smelling it through the vents. Nobody wants to smell a dead skunk everyday in their vents. Not sure of the laws in Canada though. I know in the states you can be evicted for it. They just need to show a line of proof of times they tried to contact you about it.

I took one year of law school and dropped out, but in contracts class one thing I learned was that even the courts will defer to the HOA in almost any legal proceeding. The HOA is very powerful and there is little one can do interfere with chit that is mandated.
OP should understand that he should talk the person (most likely from an HOA management company acting via proxy and not from anyone on the actual HOA board themselves) and not try to put it off else they will likely just start applying monthly fines.
