UPDATE: She called my insurance and said she was taking her passenger to the doctor (8 year old). Not that she HAD taken him but that she WAS going to. They asked ask her to make a recorded statement on the incident and she refused. I gave my account (fully backed out and shifting gear when hit) and they will now determine fault and proceed from there. Strongly considering a lawyer. Confirmed she has suspended license and no insurance.
I was fully out of the driveway and switching to drive when she hit my rear bumper (her passenger side front end hit me). She got out and first thing she said was "I don't have any insurance". I told her I'd call the police and she insisted we did not and that she would get her car fixed on her own. My damage as minimal (need a new bumper). Her car is fuked. We exchanged info but I didn't give her my insurance info. She called an hour after asking for my insurance info. I already filed a claim with my insurance and they(USAA) said liability lies with both parties. Am I at fault? Am I fuked now?

judging from the pics, I'd say you were at fault, but you're insured, and she isn't...so I wouldn't worry about it. If she makes any real issue about it, she'll be opening up a can of worms she doesn't need...do you have accident forgiveness?

I'm no expert on the matter but I've always heard that the person backing up is at fault almost every time. If you had fully backed out or were almost totally backed out and about to be switching it to drive, then you'd be okay. Another exception would be if she was speeding.

In this case maybe not. OP is at fault, but there's no police report to say so. Also bish can't afford/be bothered with insurance so she sure as **** won't be getting an attorney to help navigate dealing with OPs insurance. OP needs to pressure her for a quick monetary compensation and call it a day.
