I agree with it being justified. Dude is obviously not in the right frame of mind if he's keeping at it after the homeowner brings out a gun. Then he very clearly grabbed the gun. The shot was fired immediately after the shooter regained his balance. If they kept jawing at each other for a few seconds, then the shot was fired, I'd have a different opinion.
