Donald Trump’s bond has been set at $200,000 in the Georgia case accusing the former president of scheming to overturn his 2020 election loss, according to court papers filed Monday.

“The Constitution Prohibits Trump from Ever Being President Again” really makes it sound like it’s in the preamble or something, when in fact it’s just something Baude and Paulson came up with that would have to be ruled on by the Supreme Court.

The TLDR is that Secretaries of State would be within their duties to bar President Trump from the general election ballot. Some will and some won’t. Those that do—will survive legal challenges. Those that don’t bar Trump from the ballot, likely won’t survive legal challenges. This will go to the Supreme Court, and the Supreme Court will agree, according to these two.

Since legal challenges can be brought by those with standing (e.g. US Citizens) this will affect the election in every state. Seems like a long-shot to get DJT disqualified, and I can foresee numerous Secretaries of State in red states refusing even court orders to remove his name from ballots. But it would be interesting to see Thomas and Alito twist themselves into contortions to avoid an originalist argument.


And the summaries online don’t ever mention the weakest part of Baude and Paulsen's self-executing claim (meaning the power is with the states). Their paper does:

If you want to defeat Biden, getting Trump off the ballot is the only course of action. Biden will beat Trump. A literal potato will beat Trump (Biden is as close to a literal potato as a human can be and he beat Trump once already). A competent Republican can beat Biden. Everyone understands Biden is awful, but for most people, Trump is still far worse.

It's way too early to think that no one else has a chance. I'd like to see people like Youngkin or Tim Scott get some traction on the GOP side or Manchin on the Dem side.
