There was a very similar situation in Arizona's history where one candidate was ahead the night of the vote until a batch of mystery ballots appeared that night and changed the outcome. The AZ courts ruled that since there was doubt as to whether those votes were legitimate they don't count....didn't make them prove the votes were fake, the fact that there was doubt was sufficient. Of course that was a long time ago and we're now a banana republic so we'll see.
