Srs answer is the reaction time it would take for someone pointing a gun at someone to process what was happening, decide to shoot, and then physically shoot, is longer than the time it takes for someone armed to decide to shoot, raise their gun, and then shoot.

There was no intent to kill made the the victims. They were both open carrying guns, with kyle have the bigger one.

Yes.

From that close a range, immobile - you're pretty much at the mercy of the gunman. Kyle choosed to shoot him, mind you, he shot him in the arm - because he knew the guy didn't intend to kill. This shows Kyles' age and lack of background knowledge, first by going towards danger, instead of staying away. Second, it shows he escalates things. He was the instigator.

It's no different than the US going to the middle East and getting retalitated by the sand people hijacking 3 planes and crashing it into a building. You are the instigator.
