What evidence has been withheld? I haven't followed much this week.

They withheld the high definition copy of the video that they processed into oblivion and made blurry. It would have proven Kyle didn’t point his firearm one of the other individuals. In other words, not only did they withhold the evidence, but they manipulated it in to straight up lie.

This is going to be a mistrial with prejudice. After the prosecution violated constitutional rights of witnesses, and now we come to find out they withheld evidence from the defense, this isn’t going to get a verdict.

A mistrial is essentially when some aspect of proper legal procedure gets screwed up to the point that there's no way to fix it and still guarantee that a fair trial can take place. When a mistrial occurs, prosecutors are allowed to re-try the case. Only the current trial and the current pool of jurors is considered to have been irredeemably tainted. And double jeopardy doesn't come into effect because the trial hasn't completed.

Mistrial with prejudice means it's over and they cannot have a retrial. Double jeopardy would then attach and it's a done deal.
There are two things the defense has to show here: 1) that the prosecutor did this intentionally, and 2) that they did it to cause a mistrial. It’s pretty unlikely that they're going to be able to convince the court the prosecution did it to get "another bite at the apple” even if they can somehow show that the prosecutor did this deliberately.

Honestly I don't think either side knows technology enough for this to be an intentional malicious mistake by the prosecution. Still it's not a good look on top of everything else, but it's going to be tough for the defense to prove it was intentional.

I will guarantee if that piece of $hit had anally raped one of your children you would feel vastly different and think death was more than warranted. These weren't late teen age kids but young boys in 7-9 age range. Being 100% real here if I found out someone raped one of my grandsons several of whom are in that age range, there is nowhere he could go where he would be safe. I'd be willing to accept the consequences afterwards too.
