I don't think there's any question regarding the fact that sexual stimulation has a huge mental component. Right? It's actually mostly mental. Sexual perversion is a thinking process problem and psycho therapy, talking, has zero affect on the thinking process other than for concluding that faking change is the best option to get it to stop. Reckless homicide still carries a punishment of up to 60 years. That doesn’t seem likely to me. The “compromise charges” still carry a maximum penalty of more than 12 years. If they all agree that he’s guilty to some extent they might settle on those, but if there are one or more jurors that think he’s innocent of everything they’re not going to “compromise” on 12+ years.

A reckless endangerment charge would get tossed/overturned. You can't say he was defending himself and guilty of reckless endangerment at the same time. Wisconsin already has case law on this. The attackers were chasing him as he was attempting to flee. He acted on his duty to flee and the attackers did not let up. Reckless endangerment case law only decided that when a home owner chased burglars out of the house and shot them while they were fleeing. This is the opposite of that.

The logic here is this; if it’s not murder, it’s self-defense. If it’s self-defense, there is no reckless endangerment.

If the jury comes out with a guilty verdict, the judge will overturn the ruling and call for a mistrial with prejudice. Otherwise, it should be a not guilty verdict.

That being said, inside information is saying a jury member is holding up the process. It seems that she’s deliberately pushing for a mistrial so the case can be retried? The judge gave a bad call when he said that the jurors can do their own research on definitions. This could lead to a guilty verdict in itself
