So what will this EO do if they have proof of any of it? How in the world will that effect who is POTUS? Let’s say the electors pick Biden. I'll do my best to explain how I think this is.

Guiliani is SOLELY appealing the dismissal with prejudice and denied motion of leave to amend his complaint.

This is because in their amendment a week ago, they deleted a key portion of their case, and cannot add it back in without agreement from opposing counsel or the judge allowing a motion of leave to amend.

Since the judge denied the motion of leave, to amend their complaint to add in the deleted portion, a proper appeal to the third circuit or SCOTUS would immediately be lost because their complaint has no evidence. When a complaint is dismissed with prejudice, you can no longer add anything to the argument.

So Giuliani wants ONLY the motion of leave to amend to be allowed, so they can continue an argument in District Court, not Circuit court. In District Court they can include arguments and evidence that can be appealed properly to Circuit Court and possibly SCOTUS.

The judge denied the motion to amend due to undue delay because PA certifies Monday.

This appeal will likely be denied unless the Circuit Court is sympathetic to the Giuliani team and rules the District Judge should not have denied the motion to amend.

I think the appeal will be denied because the Giuliani team cited the wrong reason the judge denied the motion of leave to amend.

That's my take on it, I could be wrong.

A motion of leave to amend needs to either be agreed by the opposition or allowed at the discretion of the judge. The judge chose to deny the amendment and cited why (undue delay) when he did not have to cite why; the opposing counsel obviously would not agree to allow Giuliani to amend.

PA certifies tomorrow, as does Michigan.
