    Is my landlord correct about our disagreement? (srs) (will rep)

    It's a one year lease for a condo. I had a verbal discussion with him about an early termination to cover something like a job loss, relocation, etc.

    He agreed verbally and also sent a text saying that I could terminate my lease with a 60 day notice.

    However I tried to terminate on September 26th, and mentioned to him that I would only be paying 60 days of rent, but he is saying I owe him October + November in full.

    For me, the extra 5 days is close to $300.

    He says the notice has to be a whole month, he said I can't just count the days.

    Is he right? The agreement is only in text, not on the lease.

    Location would be nice to know, but pretty sure almost universally, you owe him for the full month.

    Local laws state 60 days, it's not clear whether it's by rental period. However, there is also a section on losses incurred by the landlord due to the early termination... So I would advise OP to forget about the $300 and just get it in writing.

    I just checked my records and apparently he did put a 60 day notice in the lease renewal papers. It clearly says 60 days in there.

    What now?

    Hmmm. That does change everything. Does it specify rental periods?

    Edit : I really need to read before I post. That's a 60 day notice for renewing, not breaking lease early.

    So what happened is when I renewed in March 2019, that 60 day termination verbiage was in there. But now I have the same renewal paper (without the 60 day verbiage) for March 2020, but it says the same terms as the previous renewal. It does not specify rental periods.

    Not sure what you mean. He sends me a short form every year of the entire lease, for renewing. The terms stay the same year to year.

    In 2019 he had the 60 day termination verbiage in the renewal papers. In 2020 he did not have that verbiage in there, but it said the renewal is to extend the current lease, which follows the 2019 lease terms.

    You're only 6 months into the lease so that 60 day renewal notice verbiage is a moot point. The only thing that matters is what's in the section covering early termination. Some will allow you to sub-lease to another party while still being liable and others will charge a termination fee of several months. If your lease doesn't cover details of early termination then whatever you have in writing through text with the landlord will be binding and considered your out clause. And if prorate wasn't covered then it is more than likely not allowable and you do indeed owe rent for full month.

    By the way, check the contract because MOST rental agreements have clauses that say you are liable for all the marketing(re-advertising) costs, rental loss up until someone new signs an agreement, paperwork costs to end your lease etc. It's a pain in the cornhole terminating a lease early.

    The link I posted has a number for free legal aid services. They're only doing phone interview at the moment because of Covid. Since your case is time sensitive its worth a shot. They have the added option of scheduling appointment/ ask question online.
