They can always upcharge it to 2nd degree as well. I've heard arguments from legal analysts that it's actually a much stronger case for 2nd degree, which I don't really understand

Premeditation and intent is what separates the second from the third. It really turns on what evidence you can use to prove intent.

Charges can be amended at any time if further evidence comes out. For instance, if someone murders their neighbor after getting sick of dealing with their nonsense and all evidence points to a single argument escalating into the guy beating his neighbor to death, the DA would more than likely charge them with second degree murder. They secure a warrant to investigate cell phone records, computer searches, etc. And it turns out the man was googling "best way to dispose of a body" a month before he kills him and there is a text to his best friend saying "I'm going to kill my neighbor the next time he has a party" then the DA can amend the charge to 1st degree murder (completely separate charge) and dismiss the 2nd degree murder charge.

1st degree murder is the only murder charge in which evidence shows premeditation. 2nd degree murder you have to prove beyond a reasonable doubt that they intentionally killed someone without it being premeditated. In the example above, that would be like the man having one too many drinks and just fed up with his neighbor, he walks over there, a fight ensues, and he gets on top of his neighbor and beats him to the point that he knows he's killing him and doesn't stop. Third degree murder is essentially manslaughter. Actually depending on the state you're in, 3rd degree murder, 1st degree manslaughter, voluntary manslaughter, etc. can mean the same thing. Here in Illinois, 2nd degree murder used to be called voluntary manslaughter. Here is Minnesota's statute...

"Whoever, without intent to effect the death of any person, causes the death of another by perpetrating an act eminently dangerous to others and evincing a depraved mind, without regard for human life, is guilty of murder in the third degree," Minnesota statue says"


An example of this would be like the guy getting sick of his neighbor having parties so he launches a rock over the fence into the party and it hits someone in the temple and they die.



With that, it's going to be hard to prove second degree murder. They have to convince the jury and prove beyond a reasonable doubt that the officer knew he was killing George Floyd. This is where the waters get really murky.

Coronary artery disease and hypertensive heart disease means nothing without further detail. Finding chronic disease at autopsy is really not unusual and will often be added as a relevant finding. But a bit speculative occasionally. Cardiomyopathy increases risk of deadly arrhythmia sure but nothing is said about the severity. 'Potential intoxicants' lol this phrase is straight up bizarre - it's like they don't have any tox report yet but are adding it to the list of things that contributed to his death.

By far the most relevant fact in working out how he died is that he was first alive, then he had a knee pressed on his neck for 8 minutes, then he died. The only thing that would top this is real evidence of an acute condition e.g. massive pulmonary embolism or coronary occlusion or something like that which could explain a fairly quick deterioration. Otherwise, all the money is on the knee
