    A federal judge issued a permanent nationwide injunction Thursday against yet another Trump administration immigration policy: a move to make it harder for foreigners to remain in the U.S. after their legal status runs out.

    U.S. District Court Judge Loretta Biggs said the 2018 action by the U.S. Citizenship and Immigration Service ran afoul of federal law.

    The policy in dispute involves how immigration officials calculate the duration of a foreigner's "unlawful presence" in the U.S.. Several American college presidents sued over the change, arguing that it could jeopardize more than one million foreign students, scholars, and others who sometimes lose their legal status when switching schools or for other reasons.

    Did you read the opinion or just who wrote it? I have not but I would be interested in her reasoning for the nationwide injunction. These injuctions are definitely something the SCOTUS needs to address.

    they want to get rid of them (the right wing judges anyway). But its stupid to do so. If something is found illegal it cannot be allowed to go in place elsewhere in the country. That would become a mess and federal law and the constitution are't state limited.

    In her ruling she says the new policy doesn't follow the law. People who wish to limit the ability of the judges to stop these measures are shady individuals hoping to be able to carry out illegal acts without effective restrictions. Same authoritarian BS these people are pushing for constantly.

    Biggs, an appointee of President Barack Obama, said in her 26-page decision that the new policy "impermissibly conflicts" with immigration law. She also said the new procedures should have been subject to public "notice and comment" before it was implemented. The permanent injunction she ordered Thursday tracked with a preliminary injunction she issued in May.

    it seems these judges are simply following the letter of the law. This is not acceptable for people who think a patriot injured in the line of duty is a traitor if he tells the truth when subpoenaed by congress. They prefer corrupt judges who don't care about the law so much as who they are loyal to.

    As much as many would like to see this as a partisan issue it just isn’t.

    This is always an issue when your opponents are in power and you aren’t. It is those in power versus those out.

    If the election flips the same people complaining about limiting them will be looking to limit them in order to ram their own agenda through.

    Now, are nationwide injunctions a valuable tool? Yes. Are nationwide injunctions overly broad? Yes.


    The only way to address universal injunction is through the court. The relatively new misuse of national injunctions is something Thomas and other justices have already questioned.

    Doesn't matter who is in power. Its a check on executive breaking the law. Maybe its new because the executive is doing more and more now. possibly as a result of congress doing less or straight up obstructing. Supposedly there were 20 of these injunctions under the Obama administration. Were there calls to stop them?

    As long as a ruling is in keeping with the law, there is no reason why it should not be nationwide. The law is nationwide.
    Is there no limit to what people will believe if it is prefaced by the phrase,
    "Scientists say" ?

    Gorsuch and Thomas have both questioned the relatively new development where a district court asserts the right to strike down a federal statute with regard to anybody anywhere in the world.

    I don’t think the Supreme Court is going to be in the business of limiting the article III courts' ability to be a check on the other branches of government but I don’t know.

    Yes, there were many. At this point, I don't think we actually know what powers the office of the President has, and nobody seems very interested in establishing the limits either.
