    People with getting tickets dismissed get in here !

    Was driving on the Mass Pike (Interstate 90) and all of a sudden everybody started braking hard. Keep in mind the roads were icy and had snowed the day before. Everybody was going between 50-60 mph and the limit on Mass Pike is 65mph. My car skidded and I rear ended a car going about 50. There was also 2 OTHER accidents on the same strip 1 which caused all the cars to brake hard. State trooper arrived on scene asked some questions which I told him what happened and he said okay youll get the police report in the mail.

    Fast forward to today and I got it... ALONG WITH A SPEEDING CITATION UNDER CMR 700 7.06 ?!?

    Question: How likely is it to get this dismissed ? Would I have to get an attorney ?

    I wouldn’t play games with it and just get an attorney.

    Not sure as to your state laws, but here we are eligible for up to one deferral every 7 years. After that is used up, it’s attorney time, all the time.

    Im sorry but whats a deferral ? I’ve never been to court before for anything so sorry if thats a noob question. How much would an attorney cost for something like this ?

    With a deferral it’s like probation. If you don’t get any similar infractions for one year, you get that ticket dropped.

    Last time I paid for an attorney for a speeding ticket it was 350$, but it was like 12 mph over, so it wasn’t as expensive as a bigger ticket.

    so if I do get a deferral would that ticket show up on my insurance/record for that 1 year ? Would it even be worth it to hire an attorney for a $50 ticket ?

    You got the ticket for driving too fast for the road conditions. An attorney would cost several hundred (my guess). The ticket is probably $100-$200. Either way, you're out the money. Missouri has some program called "Driver's School". I went by myself to court to protest a speeding ticket. Judge gave me 2 options. Pay a $150 fine or pay $75 and attend a 10 hour class over the course of 4 evenings and have the ticket dismissed. I chose the latter. I actually did learn a few things from the class.

    Ahh okay, so what do you think the likelihood that if I go by myself I get AT LEAST some kind of deal ? Ive never had any tickets before in my life for anything. I really just dont want this on my record for my insurance ?

    With no tickets. I would guess better than 50% for getting a deal. But first do some research in your own state to see if any deals can be made. When I took that "Driver's School" it was taught by a former LEO. It was an official class run by the state.

    Close your eyes and throw a dozen darts at a dartboard. One of them might hit a bullseye and stick. That's what the officer is doing with all the tickets he probably issued for an event that happened when he wasn't there.

    Unaware of your specific state vehicle code, but most states are similar to California in that "speeding" means going over the posted limit OR going too fast for the roadway conditions. The fact that you rear ended a vehicle because you couldn't stop in time during a storm means you were going too fast, therefore unsafe speed is appropriate, thus the "speeding" ticket. There is absolutely no measurement needed, if you told the officer what you posted in the original post, that would be enough to issue you a ticket.

    Going 20mph in a 40mph and rear ending someone could mean you were speeding because the "Safe speed" for that situation would mean you didn't collide. Following too closely would also apply here, they are both "Catch all" vehicle codes for this type of accident.

    So wait a second. Even though you weren't exceeding the posted limit, you were clearly going too fast for conditions, which you even told the Trooper, which he will repeat in Court for the Judge to hear

    How on god's green earth do you expect this to be thrown out?

    Also, "everybody was going 50-60" is not defensible so I'd go ahead and start saving for the ticket, and Court costs if you choose to fight it.
