    Never really understood this part of US law. Just because you are involved in a crime where someone dies I don't think you should necessarily be charged with their death unless you had some additional involvement.

    If she was tricked into giving them a ride for some innocuous reason, she'd be fine. If she's being charged, that would mean that they believe she knew what they were going to do.

    No, I get that. But if you were driving them there thinking it was just a break in then I'm not sure you should be charged with their death.

    Canadian law used to be the same. Then a really interesting case changed it. Basically two guys were going to rob a convenience store. Guy 1 didn't want to bring in any weapons. Guy 2 showed up with a gun. Guy 1 told Guy 2 he wouldn't rob the store if he brought the gun. Guy 2 said don't worry about it, its just to scare the owner, and he took the bullets out. Then, unknown to Guy 1, Guy 2 reloaded the gun and ended up killing the owner during the robbery.

    Originally Guy 1 and Guy 2 were charged with murder. The court ended up saying no, you actually have to have subjective knowledge the actions being undertaken will lead to death. Robbing a convenience store on the understanding its just a robbery without weapons isn't enough.

I noticed that when I visited the states few years ago, big ass houses with no gardens with no fences or just those 1 metre chitty ones...     If you go to commit a felony and somebody ends up dying, you are responsible. Not only that, but you may be charged with a special circumstance which would put the death penalty on the table.

    A break in can end with murder. It can end with rape. It can end with someone beaten to within an inch of their lives having to spend weeks or months in a hospital. It can result in arson. If you help someone commit a break in, and a homeowner shoots them, you should absolutely get a life sentence. Criminals are ****ing scum.

    It depends what you mean by directly contributed. The drivers level of contribution is no greater than a taxi driver who dropped them off.

    The difference being of course the driver here knew they were going to commit a break-in.

    So it's not actually the physically involvement that is at issue, it's the mental intent or element of the driver.

    I'm saying the mental intent of driving someone to commit a break in is not the same as the mental intent as someone who kills someone.

    Therefore, given the drastically different mental intent, as well as the obviously different physical acts, it's odd you would charge a driver and the actual murderer in the same way.

    A few years back a miscer dropped a guy in his house when two burglars were holding up his parents downstairs. He grabbed his dad's handgun and came down the stairs and picked one of the guys off and I think he hit the other one as he ran away (was caught that same night). In the news video I think he was actually wearing a misc stringer. There was a whole thread about it, was probably in 2012/13.
