Under existing law, including the Dietary Supplement Health and Education Act passed by Congress in 1994, the FDA can take action to remove products from the market, but the agency must first establish that such products are adulterated (e.g., that the product is unsafe) or misbranded (e.g., that the labeling is false or misleading).

While BMPEA was listed as a dietary ingredient on the product labels, the substance does not meet the statutory definition of a dietary ingredient. The supplement industry is a joke (along with the fitness industry). What do you expect from people who have little to no scientific background and do not have the proper perspective to interpret the findings of the very small amount of (uncontrolled) studies pertaining to the chit they put in their 'proprietary blends'? Most supps are useless garbage you would be better off (health wise and monetarily) not consuming. I'm a scientist (MS Geology), so I know how to place a study in its proper context. Most people do not know how, despite thinking they can learn everything on Google.
