yep apparently its the same as theft... fukin bull chit..
I was reading about it online and apparently its one of the shadier kind of laws that police often like to use to nail people.
One guy was saying how he got arrested and cautioned for "theft by finding" for his own bike!! Just because some other guy reported he lost that bike a few weeks before in an attempt to get a free bike..
Some people apparently go to police stations and report losing money, bikes and other things and then when/if anyone hands those items in or the police find it, the person gets a call saying the police have found their missing item and just says "yep, thats mine!".. apparently just reporting it is enough evidence to show that they are the owner.. no proof of ownership even needed.

lol you did good brah. Get that caution off you. You would do good to keep a job at the MOD, being a civil servant and all.
For future reference treat police like they're beggars on the street looking for money off you (they get a quota of cautions, car stops etc to earn bonuses). Don't be rude to them but don't take **** easily or lightly.
You live and learn OP. Don't beat yourself up over this.
Also internet serious business, don't post your face name or anything on forums pls. Especially when working for MOD.

yeah this has definitly been a learning curve and I am gonna do my best to get the caution lifted. Will seek legal advise when I get home.
I desperatly want to keep my job and it was a combination of fear over losing my job and the possibility of being imprisoned for robbing a person that made me panick into agreeing to do everything the cops wanted from me.
Never been in trouble before in my life so im neive as fuk about everything..

so can a person legally be given a caution for "theft by finding"?
I read that theft by finding is when a reasonable attempt at finding the owner of the item is not made.. I did turn the phone on and tried to put my sim in to see if I could get it working to see if I could get into it.
Does that not count as a reasonable attempt lol? or does everything have to be handed in to the authorities if you find it?
next time I find a tenner on the floor do I have to hand it in to the police?

Well the guy didnt actually admit it, but he as good as did admit it..
The officer said that when they questioned the phone owner while I was in my cell, the guy errd and ummd about wether it was definitly stolen or could have been lost.
The guy obviously did it because his insurance wouldnt cover loss but would cover theft..
I know if I tried sueing he would flip some bull chit story on me that it was stolen and I might make things worse for myself...
Well I will speak to a solicitor and see what they think and if I have a case...
Anyone know where I can get some free legal advice to start of with?

brah wtf... if the guy admitted he lied to his insurance...how can you still get cautioned??
I dont think you should have acccepted the caution...did you u get a chance to speak to the duty lawyer?
edit: From what i've heard, police prefer to hand out cautions because its a case closure for them since you are admitting guilt.

like I said the guy didnt admit it, but he as good as did when the police questioned him as to wether he knows for a fact it was stolen.. he could easily take the route of changing his story and saying it was definitly stolen if pressed into a corner..
I was offered a solicitor but the officer said I would be held for hours longer if I did and they made out there was no real point as I was only gonna have to pay restorative justice (which I was fine with) and I was free to go.
Basically they convinced me I didnt need a solicitor as it was all gonna be sorted that way..
Then when they dropped it on me the guy wanted to fuk me over.. I just felt pressured into signing a caution and didnt feel I had an option at that point to speak to a solicitor as the office said I only had two choices..
pay the fine
be cautioned
gonna speak to one tonight and hope I can get this overturned

in fact guys, the officer who interviewed me was the same guy who arrested me..
He said he does not usually do questionings but if I am happy and allow him to do it, I would be out of jail faster.
I said ok to that as the officer seemed alright and was telling me how he is gonna press for restorative justice on my behalf as I "seemed like a nice guy".
I didnt want to risk waiting for hours in jail longer just to get some ars hole detective who would makes things worse for me
anyway when it came to going for the interview, the officer got stopped and said he had to go ask his boss for permission to do the interview... so they stuck me back in my cell for a few more hours
it seemed really dodgy to me and as if they were doing things against their common practice...

Well I spoke to a solicitor and they said that me putting my sim in the phone to try and get it working constituted as a reasonable attempt at finding the owner.. apparently if I didnt sign the caution they would likely of just held me for a few more hours but wouldnt have been unable to pursue it any further...
however now I have signed the caution.. I would have to take it to court and it isnt likely that it would be over turned as I was in a "fit mental state" when I agreed to the caution.. which I disagree with as I was chitting pants that I was gonna get imprisoned for mugging a person...
Well just to keep you all updated who gave me advise.. im taking the caution on the chin and hope it doesnt effect any my career for the next 5 years too badly
