If I were in charge DUI would be a felony with a mandatory prison sentence on the first offense. (there would perhaps be a BAC threshold where the offense became aggravated if it was your first, but would automatically be aggravated for the second offense)
I would have given him a life sentence long before the 8th offense.

When your choices are Matt Cassel and Brady Quinn, just about anyone sounds good. I'm just not very confident about the QB class in this year's draft, and the Chiefs may feel pressured to take a top prospect if they get the first pick.

I'd probably make it a high class misdemeanor on the first offense for 0.08-0.10, a low class felony on the first offense for 0.11 or higher...and a felony on the second offense even if both were 0.08.
It would also be a felony on the first offense for a BAC of 0.06 or higher if you were at-fault in an accident that caused bodily harm to another person.
40,000-50,000 or so people die in automobile accidents every year in this country. Alcohol is a huge factor in that. It's ridiculous. People choose poorly and put other people's lives on the line.
I would also get rid of gun control, legalize marijuana, and make the drinking age 18. Among other things.
