A Manhattan judge Tuesday sentenced two members of the right-wing Proud Boys group to four years in prison for pummeling leftist Antifa members during a brawl on the Upper East Side.

Justice Mark Dwyer gave Maxwell Hare, 27, and John Kinsman, 40, terms that were six months above the minimum for the caught-on-camera skirmish near the Metropolitan Republican Club after Proud Boys founder Gavin McInnes delivered a speech.

Both defendants faced as much as 15 years. They were convicted last August at trial of attempted gang assault, attempted assault and riot stemming from the Oct. 12, 2018, melee.

“It’s a shame when some people jump up and down on a platform,” Dwyer said in an apparent reference to McInnes, “and their followers, their soldiers, get into trouble.”

He added, “I’m not sure the most moral responsibility belongs to these two defendants.”

Both Kinsman and Hare apologized for their conduct during the Manhattan Supreme Court sentencing. “I’m sorry about the whole mess. I regret the entire incident,” said Kinsman, who is married with three children. “I made a mistake.”

In a similar statement, Hare told the judge, “I made a mistake that night. I made quick decisions. I’m sorry.”

They both testified at trial that they acted in self-defense.

Assistant DA Joshua Steinglass argued for five-year prison terms.

“This was not a schoolyard brawl,” the prosecutor said. “These are adults who should know better.”

The fight unfolded shortly after McInnes’ speech ended and the Proud Boys exited the venue, as 60 protesters, including members of Antifa, massed behind barricades and jeered at them.

To avoid a confrontation, cops directed the Proud Boys west on 83rd Street, then south on Park Avenue, while they shepherded their opponents in the other direction.

As the Proud Boys neared East 82nd Street, they saw six suspected Antifa protesters, clad in back, heading toward them.

Instead of walking away, the defendants and their pals sprinted more than 100 feet toward their foes, instigating the fight, Steinglass said.

During the violent confrontation, Kinsman and Hare repeatedly punched, kicked and stomped on the outnumbered and undersize Antifa members.

The victims in the case were never identified, and Antifa refused to cooperate with the investigation. Prosecutors said that if they could have located the Antifa members, they would have also been charged.

A total of 10 Proud Boys were charged in connection with the incident. Seven of them took plea deals, and one is still awaiting trial.

“I know enough about history to know what happened in Europe in the ’30s when political street brawls were allowed to go ahead,” Dwyer said during the sentencing. “We don’t want that to happen in New York.”

They weren't charged because they got away.

That's not the fault of the judicial system.

Politically decided and I hope they appeal.

History is proof of what happens to the most hated people/demos when they don't have any power to stop it.

When that power is gone(and it will be in your lifetime) you and your family will be attacked and you will either go to prison for defending yourself or the hospital/morgue if you don't. Thats not opinion, thats the history of what happens to societies most hated people, etc.

If one doesn't believe in history then simply believe what the hard left is telling you what they plan on doing once they can not be stopped.

They ignored instructions from the police and raced to start the fight.

It was their fault.

Story as told, they raced up to fight, so yeah they should be charged.

I find the bit about Antifa refusing to cooperate disturbing though, not sure what the legal position is but I imagine if your organisation has members who frequently brawl under your banner, knowingly concealing their identity isn’t OK.

Pretty much this. While I'm all for ANTIFA members getting their asses kicked, their actions weren't very smart on this case.

This is exactly what people on the right (or just anti-far left) need to realize. Do not play identity politics back with the left or you will end up down a slippery slope yourself and into things like fascism or tribalism. We have to lead by example and be better than them in every way possible.

[i]Three people protesting a speech by right-wing provocateur Gavin McInnes on the Upper East Side were busted Friday after brawls broke out on neighboring sidewalks, cops said.

The violence started after about 80 protesters gathered outside the Metropolitan Republican Club at Third Avenue and East 83th Street, where McInnes was speaking, police said.

McInnes, a co-founder of Vice Media, heads a right-wing group called the Proud Boys, which has been characterized as a hate group by the Southern Poverty Law Center, and is a since-departed co-founder of Vice Media. The club was vandalized before McInnes’ appearance.

As the audience left at around 8:15 p.m., cops say, three protesters followed a man who broke into a run as he left the building.

The man dropped his backpack, and when he tried to pick it up, a protester punched him and took his property, cops said.

Finbarr Slonim, 20, and Caleb Perkins, 35, both of the Upper East Side, and Kai Russo, 20, from Bushwick, have been freed without bail on charges of felony burglary and misdemeanor assault.

“We vigorously dispute the allegations,” said their lawyer, Moira Meltzer Cohen.

There were no other arrests as of Saturday night, according to police.

Some social media users claim the Proud Boys were the aggressors.

“We followed Proud Boys after Gavin McInnes Republican Club event,” wrote Sandi Bachom, who posted a YouTube video of a sidewalk brawl. “Police escort walked them down Park Ave, then a small group turned down 82nd Street.

Someone tried to take one of their MAGA hats and this happened,” Bachom wrote in reference to the assault.

Photojournalist Shay Horse tweeted about a fight involving “30 (proud boys) V 3 (randoms).”

“It ended with 30 proud boys pummeling a guy on the ground screaming, ‘ARE YOU BRAVE NOW F—-T?!’” he posted.

Vandals had thrown a brick through the window of the same Republican club early Friday, scrawling two anarchy symbols on its front door and gluing the locks, cops said.
The vandalism appeared to also be tied to McInnes’ appearance.

A note found at the club after the vandalism attack read in part, “The Metropolitan Republican Club chose to invite a hipster-fascist clown to dance for them, content to revel in their treachery against humanity.”

But the note also ripped the party in general.

“Tonight, we put the Republican Party on notice, in defiance to the policy of mass misery they have championed,” it read. “The US government has established concentration camps around the country for Latino people, shamelessly murders black people, and continues its war machine that has slaughtered Muslim people with impunity for decades.”

Police Commissioner O’Neil on Saturday said that video recordings of the brawls are being reviewed to determine if more arrests are warranted.
