NEED HELP - cut foot on glass at nightclub
Hello, last night I was at a very upscale small night club/lounge, the kind with 16$ martinis.. anyways, I was at our couch and I got up at I stepped on a large thick piece of broken glass, from the bottom half of a water glass that I guess fell and broke earlier in the night. I went threw my shoes and into my bottom of my foot. I lost a lot of blood on the floor and none of the buss boys, waitresses, bouncers did anything for about 15min, It was near closing time so everyone was busy I guess...but the manager finally came over and said he will pick up the hospital bill. - thankfully it was a wound that didn't need stiches, but I got X-rays to see if there way in glass in my foot, and several shots, and a 96$ presctiption of antibiotics.
My shoes are obviously ruined at 125$. What would everyone else do? I was to also bill him for 2 days of staying home since I can't work.
I need some advice!

Talk to a lawyer, i see potential in this case. I think his nightclub was neglegent in not helping you out soon enough and having broken glass on the ground. You can make quite a bit of money im guessing. I dont really like the idea of suing but hey its America so its all good.

I'd only sue for your losses which were directly caused by the accident...If he(manager) doesn't pay you for your time lost, your hospital bills, and your shoes, then I'd sure.

What would I sue for? Besides to cover all the bills?
I was at the ER till 5am, and I was suppose to hook up with some girls at a hotel that I met, so I missed out on some sex.. Plus I can't really work today or tomorrow.

thats what you get for being a stupid drunk, if i were the bartender i would come over and make sure you pay your bill before you left, maybe throw in some ass-hole comment like, "wow, that looks nasty, might need to go to the ER."
Edit: no point in a lawsuit, he has insurance, and i'm sure you do, they will cover the costs.

Talk to lawyer, sue for all your medical bills and damages. That's all you really can do, maybe the missed days at work.
Unless you can get a really really good (aka expensive) lawyer and i'm sure he can get you thousands of doallrs for other things but he will also cost you thousands of dollars.

If I was you I'd go see the manager and just basically tell him your situation...that is what you have lost. Don't be silly and mention the hotel thing with a girl. Just mention direct stuff...shoes/hospital bill and maybe the work thing. I think you'll find he will cover you completely (that is unless he is a complete cheap skate...which i doubt considering the type of club). There is no need to see a lawyer unless he doesn't give you what you were wanting...it will cost you more to see a lawyer anyway.

Not necassarily. It might not even make it to the judge, but instead be settled with the prosecuter. He is definately entitled to the cost of the medical bills, shoes, and time off from work. This isn't some bar where "**** happens" he said this was more upscale where I would think you wouldn't expect to come out with injuries.

"Pain and suffering"? Some lady spilled coffee on herself at Mc Donalds a few years back, causing a some 3rd degree burns, and ended up successfully suing them for $2.9 million, way more than her medical bills cost I'm sure.

Thanks guys, I'm not really looking to get any money, just not get the run around if I give them the bill for my time not working, hospital, shoes, prescription. It will be over $2500
Also, I was sober. So I was not drunk & I'm a big guy so there is no way that I would let some bartendar tell me that while i was laying on a couch with blood gushing out of my foot.

If people can sue and win for slip and fall because of a wet floor, this definately qualifies as trial worthy. People at the clubs can be real dicks sometimes, but that's only because they deal with sh*t like this, day in and day out. So don't be surprised if they are well prepared to fight back.
You might be able to sue for neglegence.
If the lawyer is willing to take the case without an upfront fee, I would do it. Otherwise you're talking about 2-4k upfront and no guarantees.
Try something like an injury helpline.
Remember these club owners can have very deep roots. IMO... You don't wanna get into a legal battle with these guys.

Thanks, I mean I can afford a lawyer and I have met the manager plenty of times. Plus I knows one of th eowners daughters. This is a place i got to twice a week and they know me there.
I don't have a job that I have a set schedule. I work everyday since I work for myself. If I miss 2 days cause of work, then thats a big loss for me.

I'm at artist. I have many projects that I'm working on right now and I just don't feel motviated to do anything...since I didn't sleep all night and I'm abotu to go to bed.

I highly doubt that they will give you compensation for that, then...Expect to get a good lawyer.
