DENVER — An attorney has been charged with illegally running a short-term rental business, the Denver District Attorney’s Office said Monday.
Aaron Elinoff was charged Friday with one count of attempting to influence a public servant.
Owners of short-term rentals must use the location being rented as their primary residence under the Denver Municipal Code.
Prosecutors said Elinoff submitted an application for a short-term rental for 641 Raleigh St. in March.
As part of the application, Elinoff included a notarized affidavit that claimed his primary residence is on Raleigh Street.
But an investigation by Denver’s Excise and Licensing found Elinoff lives at 1316 Tennyson St.
On June 5, an inspector drove to the Tennyson property and saw Elinoff gardening.
When the inspector approached and asked if he lived there, Elinoff told her yes, prosecutors said. He then declined to answer any more questions.
The inspector drove to the Raleigh Street house where she saw Elinoff go inside.
The inspector talked with neighbors at both locations and determined the Tennyson Street house was Elinoff’s primary residence.
Prosecutors allege Elinoff made a false statement in the notarized affidavit. He is due in court on July 17.

Nope, not in Denver. Anywhere else in the state of CO? Perfectly fine. But Denver will throw your ass straight in jail.
Seriously. Feel free to take a public chit on the sidewalk in Denver. That's now legal. But HOW DARE you even think of renting out your own property that you don't even live in.
The hotel lobby can fist itself.See title.

You guys are seriously discounting how people abuse AirBnB. Outside from the fact it might run afoul of local laws (like zoning or primary residence in this case) or strata regulations, some people straight up turn their property into an unmanageable slum to maximize short-term revenue. Super common for people doing STR's here to straight up tell guests to not interact with anyone so they don't raise suspicious of going against bylaws lmao. Some foreign lady around here even turned a 3-bed + basement townhome into a fukkin 20-person traveler's hotel, and the fines she got assessed with far outweighed the revenue she made and the disruption she caused to her neighbors.
As much as I hate NIMBY types, I wouldn't want to buy a home in a residential neighborhood then get surrounded by what are effectively unregulated and unsupervised hotels, which is why to me it makes sense to have municipal licensing to add accountability at the local level. Of course most cities might not need to do this because they aren't really travel destinations, but anywhere that's touristic it's a genuine issue.Go Canucks Go!

Aware. There is a building near me that got bought by some Russian company. They put bunk beds in the rooms of the units so that each one can hold 12 or so people. The drama on the nextdoor app has been quite spicy. I agree, there does need to be some regulation so people can't run cut rate hotels from residences but I would think if you own the place you should be able to do with it as you please as long as its within the guidelines of the app/city.
Every one I've stayed in has obviously only been used as an AirBnB.
