Who in their right minds actually believed that this would not be the outcome? The ruling pretty much echoes what I had been saying.
Look folks, if you use an effective but questionable ingredient in your product that the FDA is already eyeing, don't go around boasting about using the ingredient like a Vegas billboard with flashing lights. That's how you assure yourself that the damn thing would get banned quick. If this is an ingredient which is already on the FDA's hit list and the FDA had already sent out warnings, don't be an idiot and argue with the FDA about it, insult them, and then try to sue them when you know that you have pretty much no evidence to support your case. This is what effs it up for others in the industry.
I would also like to point out that this ruling was a granting of the FDA's movement for summary judgement. What did I say about this not so long ago? That this would be the outcome, including what a movement for summary judgement is for, and why the FDA would request for one. It's been dragged out because it's really not much of a priority case. Standard procedure. The moment the FDA filed for a motion for summary judgement, that in and of itself indicated two things 1) the FDA had enough to end the case and 2) the case was going to end soon. Hi-Tech would have LOVED to drag it out longer even when they knew that they were going to lose the case, reason being that it is a resource drain for the FDA and it would have added more to Hi-Tech's PR campaign.
As for Hi-Tech motioning for summary judgement, that was to be expected, as their prerogative was to drag the case out as long as possible, so it was another maneuver to do so.

Why is everyone upset about this? DMAA is awful for you and increases the chance for high blood pressure, heart attack, and stroke. This NEEDED to happen. We should be thanking the FDA

Few years back they had on several tv shows search it kids like grade school - highschool would chug energy drinks including redbull, monster, nos, rockstars etc 10-15 or even 20 in a row were bragging about it on news shows/talk shows it was a game many of them were sent to the ER thought I heard one kid had a heart attack? but this was long while back now.
Many schools following also had banned them just FYI dunno about anyone having died as a result but given tolerances of caffeine and kids chugging a lot of them within a very short time span its not impossible. People have killed themselves having drank too much water too quick and that is well documented look at rave scenes.-- Microwaves everyday crew --

I'm pretty sure none have died and carguy is spreading fake news. But he seems pretty sure, stating "another" has, as in, at least one did prior and now an additional one did...recently.
If multiple kids have died from Red Bull (or any energy drink) I am highly interested in knowing the available details, though.

Like I said I have no idea but your talking 1-4g of caffeine in young children within a fairly small time table I have not heard much about this in couple years but it was blowing up at one point as some kind of "Game" I want to know who's parents are buying them unlimited energy drinks lol like here is 150$ worth of energy drinks just chug them whenever.. Lol wut as a child had I asked for something like that prob got told "Get a job".

Ther have been many cases of death from caffeine intake. In almost every case, one or two reasons are why: high intake ( like 8 or so energy drinks ) or an underlying condition. Ephedrine was linked to the same.
It's a common factor in stims where abuse or other factors are the cause, not simple use barring other ingredients in the formula unknown to the person consuming.Your nutrition and workout program determines your success.
