Even if he decided to sue wouldn't it be your insurance company that would foot the bill? That's how it'd be if he was in a car, no idea about car on pedestrian accidents tho.

Ah NY....****ing ridiculous. I would recommend going to speak with a therapist once or twice in the next week. You may need it, but even if not I would personally love to have it on record that I required counseling as a direct result of this gentleman's illegal actions. Then when the lawsuit gets threatened by the parents you fire right back by filing a multi-million dollar lawsuit for the mental anguish his illegal actions caused. Why? Because THAT'S the American way.

I was in complete shock all I remember was hitting him, him sliding up the hood a bit then going forward in front of the car and just laying there. I legit screamed out "oh my god" cause I thought I hit an old man or lady and killed them.

everything is in your odds it seems, just hire a lawyer if they decide to sue you but if you have a decent insurance company, they will just take care of everything. Not a big deal unless the damage is permanent(he has to prove the damage is permanent to the court if he wants to sue for big money which is very hard to prove and the cost is huge, most lawyers wouldn't take this case up unless the chance of winning is high.)

Its okay, I did the same thing when I was 17. It was 5am and i had to be at school early, made my usual left turn and hit someone on their bike. He was wearing all black, black bike with no lights, freaked tf out. Pulled over immediately and ran to him.. He was getting up, his bike was fine, he was bleeding from his head (little scratch) Asked him all the same things, ran back to my car and got him a towel and some water. Asked to call the ambulance, he just shook my hand and went about his day on the bike... Had to be in his 40's or 50's.

If you are sued it will be based in negligence. The damages will be reduced proportionately through the guy who got hits own contributory negligence.
Sitting in the road is way more negligent than illegally crossing at night in a black hoodie, so the amount he could successfully claim would be reduced even more.Make Misc Great Again

Something similar almost happened to me
Coming home from gym around 10pm. Rainy night. Guy runs across the 4 lane 65mph road wearing all black. I missed him by an inch... I called the state highway patrol to report what happened and they told me "if he ran across at night wearing all black with a green light in the direction he was walking, you wouldnt have been charged with anything"i would take her temperature with my beef thermometer.

Yeah absolutely. But contributory negligence works as proportion of fault. So let's say he made out a claim for 100k but because he was wearing a black hoodie at night he is 20% contributorily negilgnet. That would mean he could only recover 80k. Whereas by sitting he would be say 60% contributorily negilgnet. So he could only recover 40k.
