I did watch the video. About the time he hit the ground I couldnt really see chit except a bunch of officers around. Maybe I missed the outstretched hand part.
He wasn't gurgling, his speech was clear as a bell to me. This is a pretty standard technique that people resisting arrest will do though, especially if there is a camera around to try and get some leverage in court and/or get some space in order to continue fighting.
He didn't die right away. After it was discovered he was in fact choking, they let up. He was seizing so he clearly wasn't choked until he died.
I'm sorry you don't have faith in the system. If it makes you feel any better, I dont either sometimes. I don't think cops are perfect, but I honestly dont see too much wrong with this situation. It's unfortunate he died to be sure. But I think it's way to early to basically conclude that the cops were wrong. I don't expect to change your mind. I just wish more citizens could experience a situation like this. I feel like it would be eye opening. No hard feelings.Last edited by 2StepsFromHell; 08-01-2014 at 11:08 PM.

Looks as though he'll be charged, more than likely with some kind of manslaughter (which is not 2nd degree murder OP) and have a jury trial. I don't see 12 coming to the conclusion that the officer intended to kill Garner with his actions.
I love how you turds will jump on a band wagon without reason to hate on the police to suit your view. I sincerely hope that anytime a choke-hold or grabbing around the neck is used by anyone police or not that the attempted murder charge is applied. But that doesnt make much sense does it?
If they over charge as they usually do with something like 2nd degree murder, he'll def walk. Then get his job back.Homerotic Modulator, Envious of Idiocy

Why don't you do it then?
Btw saw your post a ways back. That 3 weeks leave with pay is only while it's being investigated. If found guilty then the real punishment will start. People always just hear about the paid admin leave and think that's all that happens, it's not. Just wanted to clear that up.

I'm rational and exercise discretion on a case by case basis; I agree that jumping on the bandwagon to hate on police is stupid. Obviously you know my opinion about this situation, but I don't hate cops in general, it's just that seeing things like this really irks me. That being said, I think it's also a two way street. I don't think cops should blindly defend other cops actions based on the brotherhood mentality or the fact that they know the day to day things that cops see that go largely unnoticed in everyday society.

Don't get me wrong I respect cops..it's a hell of a job and a responsibility and whatnot it's just that most of them can't handle it, most of them don't respect the job or the honor and the law, and in today's afermitive action age where the color of your skin or your race or nationality will get you a job before your qualifications (to dervesify) a lot of cops shouldn't even be cops in the first place
In NYC it's 20 years and out with half pension with benefits for life and it starts at 35k, goes to 75k and you can easily get to 90k or more, seems like a gig that a lot of people would want even if they don't want to actually be a cop and they hate the job
I'd be miserable for 40 hours a week for 20 years if it means I get to collect 50k a year for the remaining 50 years or so of my life for nothing

First let me preface this by saying I do not like the police. I have my own personal reasons but lets just say I am not their biggest fan, not even close.
That being said, he WAS resisting arrest. He did not comply with anything the officers were asking him to do UNTIL he was on the ground.
I timed it. He was in a chokehold for 14 seconds. Long enough to suffocate him? I don't think so. Sure, he could have had his windpipe crushed that would cut off his oxygen, but the guy was talking and he wasn't weazing. To me that tells me he was getting air.
This was an unfortunate series of events that led to this mans death. From resisting, to the brief choke hold, and last but probably most importantly, the mans severe obesity, asthma, and poor heart condition.
Should there be a murder charge? No.

I agree, I dont blindly defend anyone. I speak from experience on the police end. The guy committed a policy violation which compounds things into criminal charges for himself. In this particular case sure it looks bad and he'll have to face the justice system due to his actions now that the medical ruling is in. Big dude with health problems, in my experience I dont see a conviction, better they plea to a lesser charge and be done with it.

For sure bro. Definitely some folks in my dept that I wonder about sometimes. Still, I've yet to meet a cop though that would willingly kill someone cause they think they can get away with it. Most of us are scared to death of situations like this because we all understand how it looks to the general population. I guess I can argue til I'm blue in the face but people need a villain. Just having a hard time accepting the fact that the villain is probably going to be me, deserved or not. Cheers m8.
