The dog/human situation is simple, direct, and there is no mistaking your intentions. There is clearly no malicious intent towards another human being by eating fast food, as per your example. However, the intent is obvious if you let a human die in favor of a dog.

Op never mentioned how the other person would die or what the situation would be like, you're assuming things. He said either your dog or someone randomly would die. If there was a person drowning and my dog drowning in front of me obviously i would save the person but if someone randomly just drops dead in Africa i would pick my dog. I also have no idea what that random person's personality is or what their morals are so ofc i would pick my dog.

My dog is like my child. I got her when she was not even 3 months old. She was with me when I moved to a new city and knew nobody. Sleeps next to me every single night, gets so excited to see me when I get home she can't stand still, jumps into my arms, barks when strangers are at the door... it's not so cut and dry for the people that actually own dogs.

I can honestly say I'm not 100% sure which I would save, but I'm calling bullchit on this. Failure to make a sacrifice (the life of your dog) in order to save a random person does not constitute 'malicious intent' towards that person. You did not put them in the situation of needing to be saved. You don't wish them harm. You just happen to value an alternative more than their life. Some people REALLY love their dogs. Whether that is right or not, who can say?

What if the choice is between two strangers? Do you have malicious intent towards the one you don't choose?
