My cutting failed - and they said oops!
Ok - So I thought I would do some cutting to bring down my % of b/f as well as try and drop 10 to 15 lbs of weight.
I went in and saw the Nutritionist and dietitian at the gym with their certificates hanging on the wall.
I started my meal plan. After 4 weeks I noticed a change in how my cloths were fitting which alarmed me a little cause they were getting tighter -
So I stopped what I was doing and low and behold I had gained some weight
So last week I went in and saw them again - they looked at the chart and the lady said oops! - I missed read some of your figures - your calorie counts on 4 days was way too high for trying to loose weight -
Being nice - they offered to redesign a plan - now at an additional cost - to help me loose the weight - I walked out
Does that sound fair?

You should not have to pay them again for a mistake that was there fault, If you had given the wrong information to them thats one thing. I would let them know that! Why do you need to pay someone to help you lose weight. There are enough people on these boards who have gone through what you are trying to do, just ask. Filter through the stupid responses that are given and do some research, spend your money on good food instead.

Sorry - I forgot to mention - that the original consult and setting up the meal plan was a free promotional offer at the gym - Now I know why - So I would have to pay to fix what they did - I am just glad I didn't follow it for the two months like I was told -

Sounds like typical "health" club stuff to me. MY 24Hr Fitness BF testing is actually getting so far out there in an attempt to get you to sign up for personal training. I'm 5"10", 180 lbs and more than once my BF%, according to them, has been from 25-30% and I must use their training immediately. While I'm fairly sure I'm around 18-19% BF, I'm far from obese and ready to drop.
Chalk this one up to experience and let it drop, you aren't too late for summer if you focus.

24 hour fittness will make you out you think you have more bodyfat than you really have and get you to pay alot of money to do some short of cookie cutter, circuit training and cardio. With toys.

These people are not professional and have no pride in their job or they would have fixed the problem. If they were professional they would have made sure that the second time they tracked you carefully and made sure that you were losing weight on their plan. (for Free again)
Unfortunately that is the way of the industry - in a lot of clubs - Sales, sales, sales, when it should be result oriented for the client.

Talk to the manager of the gym, tell him/her what happened and try to get another 6 - 12 month extension on your current contract to make up the difference.
Then, post the crap that the dietician/nutritionist/jerkoff trainer from the gym gave you here and we'll fix it for you and hopefully educate you in the process to the point where you will have little to no need of one of those persons in the future, or, if you do, that you will at least have a solid base and foundation to know when you're being sold wolf tickets.

The problem with taking them to court is that it will cost you money. You will either need them to admit wrongdoing (won't happen) or your own expert to demonstrate that the advice, if it was in writing, was incorrect. The pain in the ass aspect of this far exceeds any potential rewards.
Malpractice is another problem, in that there is no legal "generally accepted professional standard" out there concerning this. This mean they cannot have violated it, which means malpractice is out. Even if there was, you would have to demonstrate injury/damages to the client, which sounds unlikely and somewhat specious to try.
