SAN FRANCISCO (AP) - A federal appeals court is set to consider the case of three students who were sent home from a Northern California high school for refusing to remove shirts emblazoned with the American flag on Cinco de Mayo.
On Thursday the 9th U.S. Circuit Court of Appeals in San Francisco will hear oral arguments after a lower court tossed out the case in 2011.
School officials argued that students' civil rights can be curtailed to ensure safety and limit disruptions. The lower court agreed and the students appealed.
The students wore the shirts on May 5, 2010. Mexicans celebrate that day as "Cinco de Mayo," and compare it to the United States' July Fourth observance. Unpleasant verbal exchanges and altercations marked the previous year's celebrations at Live Oak High School in Morgan Hill, 20 miles south of San Jose.

This is america, it is not our national holiday. You're in our country, abide by our laws and regulations.

Depending on the evidence, I'd be surprised if this gets held up on appeal. This case seems very similar to Tinker v. Des Moines School District, where the Supreme Court ruled that a student could wear a black armband to protest the Vietnam war.
But I think the case will turn on how much evidence there was that wearing the shirt would cause a disruption. Without an concrete evidence that it would cause problems, I don't see why the rule in Tinker that "undifferentiated fear or apprehension of disturbance is not enough to overcome the right to freedom of expression" wouldn't apply here.Squat: 425

Pretty sure they mean Cinco de Mayo. I agree being sent home for wearing the T shirt is stupid. But you can't honestly argue that should not use non-english words when in America, a country that has no national language and guarantees free speech.
