I read pages 1 through 16 when the question occurred to me - who was it that found the incriminating hair? Was it the family of the victim, or was it some other child protective services?

If this question was raised and subsequently answered between the pages of 16 and 26 then pardon me for being hasty. But surely this piece of evidence, upon which this case is so strongly based, needs to have a clearer chain of custody (or whatever it may be called) scrutinized.


edit - I suppose my question is ultimately this:

did the family of the victim produce the hair and inform the police where they claim it was found, or did the police find it where the prosecution is claiming it was found?

There is NO WAY a court convicts a man for 50 years because of what a 2 year old "says" (lol) and becuase of a male hair strand found on the 2 year olds underwear that they couldnt even identify. Nope. But the funny thing is, the allegations were from a 2 year old that was staying at my mothers licensed in home day care. She accused my mother and FATHER of doing the same thing. They only charged my dad. They convicted my dad on 1 piece of evidence and that was a male hair strand they found on the outside of the "victims" panties.

I've read the whole thread, something doesn't seem right. I can't believe, even in the most potato parts of America, that a jury would find someone guilty beyond reasonable doubt on the word of a 2 year old and a hair, which couldn't even be proven to be from the father. Not only that, but also getting 50 years for it. I know Texas loves the death penalty, but come on.

We had a case here in the UK recently where a man was charged with raping a child of 6, she is now 14 and even gave evidence in court. Sobbing, the full works. He was still found innocent as basically it came down to his word against hers. No other evidence.

I know people are wrongly found guilty, but in those cases theres a witness or some evidence which sways the jury. If reading what op has said, where is that evidence in this case? That hair can't prove squat, and certainly the word of a 2 year old wouldn't in itself be enough. I'm sure the other allegations weren't even allowed to be used if they were dropped before trial. What witnesses did the prosecution call? Were they all professionals, or did they call family members of the accuser? And why weren't you called if you were in the room, left for 5 minutes and when you came back, no one had moved, or nothing was heard?

Would love to read full transcripts in a few weeks, op. If you're not omitting any information, this must be one of the most messed up cases in recent years. Must be grounds for appeal.
