^^ Thanks. 3.2 (on page 3) and 4.4-4.7 are the only real issues there IMO.
The whole stuff about whining that Jason referred to Layne as Lame Norstrom is childish at best. So what if it is insulting and mocking. This is the interwebz.
It cracked me up that these lawyers actually included Bagpuss in the whole matter, "to mock our client."
Seriously, I hope that Jason is considering sending them a counteroffer to settle, maybe agreeing to taking down the youtube videos in question, promising to not say mean stuff to Layne again, and telling them to shove it with the money. The promise to the court is a sneaky thing because it has real teeth because he can be found in contempt if he violates that, and THAT is much easier for Layne to be successful on I bet.

From posts I've seen, he has no intentions to settle. In fact, he doesn't even feel threatened if he does lose because his assets are all in the US. I've stated my views with him. Not to mention, how his manner of taking the whole situation as a joke not only undermines his case, but his overall cause of bringing truth to the surface. I think it is a disservice to anyone else who may try to do something similar because if he loses the case then it opens a big can of worms and further protects the supplement industry which is built upon lies.

No worries.
It's not quite that cut and dry - nothing ever is There are good points that can be made on both sides.
In my humble opinion regardless of the rights and wrongs of this, if the case does get litigated and does go to trial neither man will emerge completely unscathed. It will have a financial and emotional cost to both men - not to mention the time lost spent fighting it.

Wow! I'm not a huge fan of Jason, but I have lost all respect for Layne with that letter. It basically stated that Layne is entitled for compensation for damages they can't prove exist. How exactly does that work? You don't get to go to court over hurt feelings. There must be actual damages that you incurred. Then the letter continues to say that they demand payment of these unspecified damages as part of the settlement to not sue him. How can Jason possibly even remedy this part of the letter? Its impossible! No damages were even provided.
Then on top of the unspecified damages they seek they Jason to pay for Lane's full legal costs that somehow equated to ~$23,000. Is that the price for drafting this letter? How does this work?
I can see possibly sending a cease and desist order asking Jason to take down the youtube videos. I think all Jason has to do is show up to court because he now has undeniable proof Layne isn't natty. I would personally recommend that Jason just show up to court and hand the judge this letter and say that there is no way that a menstruating vagina of this size is capable of producing enough endogenous testosterone to become as ripped as Layne. Case dismissed!

That's not on Layne, though. The smart lawyer aims high, near high as impossible even if it sounds kinda dumb at first blush, because it "averages down/sorts itself" further towards the finish line. Even the lawyer knows it's not within reality—it's just how the initial moves of the chess game start. The lawyer says, "Hey Layne, your case looks good like this, I'm proposing we send: ...." Client says, "hmm... okay... ¯\_(ツ)_/¯ ". I've been on both ends of situations similar to this (w/ bigger parties/more gravity), it'll never see Court.

Nah, the lawyer "says" it's $23K of his time, but that's not really how it'll play out. He's had one of these written from his last dozen cases of similar ilk. They're hoping Jason will cave, settle up w/ "some" amount of money, which is mostly symbolic as "pound of flesh". Then lawyer will charge Layne maybe a couple 1.5-2 'K' or a percentage "depending" (how much further this goes). Typical "first four moves" of a chess game, nothing interesting yet. More entertaining would be a spin-the-globe lottery on where jurisdiction will finalize. UK, Idaho, Florida, California, Texas are the finalists (on the back of my napkin) ... and not in that order.
