Ah, okay, valid angle. The quote thing threw me. I would need to read his opinion to get a better feel for how he got to where he did and obviously I haven't read it.

Basically, he fell on the side of the "it's a tax" argument, when that very argument was vehemently denied, its onset, by the very parties that first presented it...and quickly realized that that was a bad way to appropriately present the bill. They changed legal angles to prevail...which I thought would never work!
