I'm unaware how she lost control as badly as she did, I've been in some hairy situations with rwd sports cars in the past at slower speeds but what she did blows my crap out of the water. She was either intoxicated by medicine/alcohol or texting with how that crap went down. The cop told me she stated a semi passed her and she lost control, what I think happened is she was texting and almost hit the semi and swerved to avoid and ended up taking me out.
Honestly it seemed like a reenactment of this (srs)
I remember everything happening very vividly and I specifically screamed out FUUUUUUUUCCKKKK as the airbag was opening into my face because I was so upset at my car being hit.
A lot of you guys commenting on why I'm driving a VW at my age and such, if you've never been in a decked out GLI you have NO idea what you're talking about. Comparing this to a base model Jetta is apples and oranges and it's obvious the other VW enthusiasts here get it. I've had everything from a 65 Mustang, Twin Turbo Stealth, S10 Blazer, Ford Ranger, Intrepid, 02 Mustang GT, and this thing is more comfortable, agile, overall just fun than any of those cars and gets the best gas mileage to boot!
As far as insurance goes so far I've contacted both mine and hers.. Her's stated that she is on a policy of another woman (I assume to be her mother) and that particular vehicle is NOT listed on the policy. So unless they just bought it I'm about to be SOL on this deal, my insurance will have to foot the bill and sue her for the damages. This folks is EXACTLY why you pay for full coverage insurance on any decent vehicle, I'd be out $18k on this whole thing otherwise!Military Crew

Out of this entire thing, the bold was the only thing you said right. In the event she doesn't have enough liability and property damage to cover the damage/injuries, then his UM/UIM will absord the remaining balance of that, so in essence, there's no need to try and sue if you've already been given a payout for your injuries.
At this moment, he's only got a hurt wrist, whiplash and soreness that will eventually subside in a day or two....
That's not enough to go through bullsh** court proceedings just for the **** of it. Insurance is there to help you, not for you to get over on. And yes, I know that some companies are jokes, but for the most part, a lot of them aren't....they DO want to help you.
(Yes former insurance agent, I know what I'm talking about.)

some idiot crashed into me in May, though it was a lot less severe and only the front side quarterpanel was damaged. still really scary **** to go through, never had my adrenaline pumping that hard. mine happened in a neighborhood too so of course everyone had to come out and watch, despite it being obviously not my fault.

UIM and UM doesn't cover your property damage. That's only for bodily injury. If you sue the other person for BI and you exhaust their limits, then you can use your UIM coverages which is basically suing your own policy for injury. If the other person has low property damage, even if their company accepts liability, you will either need to accept the max amount of money they can offer you or be forced to use your own collision coverage assuming you have.
What insurance company do you have and what company does she have? Hopefully it's not country wide.

now dat feel brah, nailed by a drunk driver going 50 coming out of a stop sign its not fun. But at least you walked away relatively unharmed. GL with insurance though, glad to hear you have better coverage than i did. I had liability and so i only got half of what the car was worth because the other insurance "could only cover that much" and my parents pocketed it and i had to get a POS accord. Mirin the VW though, I love anything German.

I have Progressive and she has Nationwide, I am going to just file a claim at this point and cover my $500 deductible to get the ball rolling and then get reimbursed through her company hopefully, or worst case scenario small claims court if I can't convince her to just pay up. Hopefully it doesn't resort to such..
I didn't go to the hospital, I had a paramedic check me over right quick to see if anything really gave reason to go to the hospital and I didn't have anything. I'm going into my intern tomorrow at school to get checked out as my neck/back are progressively becoming sore.

And also very lucky that girl is somewhat okay too because I don't see any airbags deployed in that weird f***ing thing of hers so I'm assuming it doesn't have any. My current car doesn't either, feels alpha as fcuk cuz.
IDK how the fcuk you lose control of a car on dry pavement. Living in the winter conditions I do and garbage roads, it just doesn't make any sense to me.

Nah, wait on this.....call her insurance company and file the claim, then wait for the adjuster to call you back to set up an appointment to look at the vehicle and determine if it's a total loss(which is more than likely is since the bags have been deployed) and to go over her policy coverages.
You don't need to do anything with your company at this point. They're at fault, they're responsible for x, y and z until you know if the damages will be fully covered or not. Make sure you get that rental car as well.

I've contacted both her insurance company and my own and done the statements for both as well. They each are going to have to wait for her to be contacted to give her statement before they can determine who's at fault (that'll be a tough decision). I don't have any sort of rental car reimbursement on my policy but I need something in the meantime so I picked up a ride tonight, swapping it out for something better/cheaper tomorrow because I took all that was left... I'm under the impression that once they figure out that she's at fault that her insurance company will reimburse me for the rental costs.
Progressive is coming to pickup the car from the tow company tomorrow so that it can go to their appraisers and get started on punching numbers for this. Is it true that I can deny their initial offer and wait for them to give me a higher amount for the vehicle? I know this used to hold true in the past and the GLI's are quite rare especially with the option package mine had. Checked Carmax already and they only had 6 of them available for the entire USA..Military Crew
