The people who think it's awkward don't understand the expression. It's a pretty common example used by lawyers. Stern is making the point that the very question itself leads to an implication that the NBA is fixing the lottery, just like asking the question "do you still beat your wife" implies that the person being asked did infact beat his wife at one point.
