Sabinsa gets court approval for case against forskolin rival


3/1/2005 - Sabinsa, maker of the forskolin weight loss supplement Forslean, has gained court approval for its case against a Missouri company marketing an extract of the Coleus forskohlii root under a similar name.

The botanical extracts company reports that a declaratory action filed against its trademark by Creative Compounds has been dismissed by a Missouri federal court.
Sabinsa, which holds a US patent for the use of forskolin as a weight management ingredient, sent a cease and desist letter to Creative Compounds in August last year after discovering the company was selling an extract of the Coleus forskohlii root under the name Forsthin.

Sabinsa took action to stop the use of the Forsthin name and recover damages for its use.

The product is seeing strong growth in the buoyant weight loss products market. Earlier this year Sabinsa said it had expanded production of the raw material to 18 zones in India. However successful herbal ingredients are also subject to considerable competition.

Sabinsa has welcomed the dismissal of Creative Compound¹s declaratory action by a Missour court, which found it served “no purpose other than to deprive Sabinsa, the real plaintiff in this dispute, of its choice of forum”.

The Declaratory Judgment Act provides a remedy that will prevent accrual of damages and give parties threatened with liability a chance to bring an action immediately to limit its damages.

Sabinsa has also filed a lawsuit in New Jersey federal court against Creative Compounds, and that action is continuing.

The suit against Syntrax Innovations, Inc., SI03, Inc., Somadyn, Inc., Creative Compounds, LLC, and Derek Wayne Cornelius was initiated for unauthorized sales of ADONIS-X arachidonic acid and its companion product HYPER-H arachidonic acid. These products induce others to infringe the patent rights of Molecular Nutrition and create unfair competition in the marketplace.

A former product from Syntrax, that caused serious health issues to their customers

The Food and Drug Administration (FDA) is warning consumers to immediately stop use of the product LipoKinetix®, marketed as a dietary supplement by Syntrax Innovations, Inc. LipoKinetix has been implicated in a number of serious liver injuries. FDA has received multiple reports of persons who developed liver injury or liver failure while using LipoKinetix.

LipoKinetix is marketed for weight loss. It contains the ingredients norephedrine (also known as phenylpropanolamine or PPA), caffeine, yohimbine, diiodothyronine, and sodium usniate. I tried it one or two times and the people were angry that I would PM them about it. I told you this and said it was also against the forum rules, to which you replied encouraging me to continue doing so as it was our job.

I didn't like this and so I quit doing it unless someone else initiated the PM'ing. Other than that, I sought out threads with questions about Syntrax and tried to answer them. I promoted in a way I felt was in line with the forum rules, even though yes, you did encourage us to do so via PM as well.

What are these supposed claims? I've always been a fan of Syntrax's stuff - SwoleN is, by far, the best and most cost-effective supplement of its kind (I've never made similar size gains with any other creatine product) and Nectar, while expensive, is great (the fruit flavors are much better for mixing).
