    Can someone try and clear this up for me? It says that New Dietary Ingredients (NDI) must be cleared by the fda before hitting the market, but what I don't get is if this means new ingredient or new product. For instance under the FDA's definition of a NDI whey protein is not classified as a New Dietary Ingredient, so would releasing a new product containing whey protein without asking the FDA be illegal? Hopefully that made sense.

    It's for ingredients after 1994. If the product contained something post 1994 that wasn't DSHEA compliant then it would need to be cleared.

    ok i'm probably about to get negged like crazy and start a sh*t storm by saying this, but here me out first. Firstly I want to say that I disagree with THIS guidance draft, and I did follow the link on the ******** page and sent a message protesting it. But that being said I believe that there should be more regulation on the supplement industry then there currently is. There are many products that are for sale legally that have many harmful side effects, and because of there legal status many unaware, and teenage consumers buy these products. However that being said I believe that this draft is going about it the wrong way. The FDA's definition for an NDI is far too broad and does need adjustments, so even though I believe more regulation is required, I don't agree with the new guidance draft.

    Basicly it means then can ban almost everything because it only ingredients that were widely used before 1994 can stay and with that logic they can ban just about anything they want to.

    As well as supplement companies having to go above and beyond any necessary measures to get a new product/ingredient onto the market, this will most likely mean alot more testing and trials, which means companies having to spend even more money producing supplements, thus forcing the consumers to shell out the extra money.
