car repair situation!!
this morning woke up and found my car had been scratched the **** out of by a work truck from some construction company and those who read my last thread its those bastards who are building a skyscraper like building RIGHT NEXT to my house..
the supervisor left a note and stuff so we talked over the phone, he explained that a truck had "tapped" my car but its ****ed up big time.
get the estimate and its about a good 4k considering the car is worth only about 1k hahahah
so misc..what should i do?!?! its my only car, if i had another one id just sell it but i need it for transportation. was thinking take the money and leave the car as is since it can still run, only it looks like its been to hell. or maybe put that 4k that they will give me and buy another car?
cliffs:
construction company scratches my jeep
damage worth 4k+
they will pay for it all
jeep worth 1k and can still run fine

so the guy is outraged by the amount...he said that 4k is just too much and will take it up to insurance. of course i have no experience dealing with insurance so he tells me that they would just give me 1k if im lucky as the jeep is so worthless...
damage = 4k
jeep worth = 1.5k kbb
he said all this shizz about deductibles but its his insurance company paying for it not mine so why would there be deductibles??

as a rule his insurance company will pay the deductible but they may direct you as to where you have to fix it. if they can fix it for a price the deem to be a lot cheaper, (as they probably know that the jeep is not worth a hell of a lot) they are better off letting the insurance pay for it and they will take a chance on their rates not going up next year. but this is a small claim so it really won't effect them compared to $4000.00 out of pocket.

Well I have no idea about how it works in Australia but if someone scratched my car (or just plain hit it) it would be up to the insurance company to cover the cost of the dude who hit me. That's the point of an insurance company to begin with lol. So I would assume the same applies to you my friend.

well he's not willing to pay 4k..thinks its too much and outrageous for the damage he did. he wants to file it to the insurance now since 4k is WAYY to much for him to pay out of his pockets.
problem is insurance will probably not pay 4k to fix a vehicle worth 1k lol
im in victoria btw

Your right, they wont. If the cost to fix exceeds the value of the car it'll be written off and the insurance company will cut you a cheque for what they deem it is worth.

take the money, and not fix it.
like that time i got into an accident.
my front right corner is busted up, insurance gave me $2500, and I saved it.
I bought my car for $1800.

No. What is meant by written off is the insurance company will make an offer that they deem resonable value for your vehicle(aka they are more or less buying the vehicle from you) You may have no choice but to take it once you go to make your insurance claim if they deem it not fit for the road.

but you see its just a few dings and scratches, runs perfectly and street legal. just the body needs some work.
so the insurance will not pay for full for my repair costs?

Not if they feel the damage exceeds the value of the car. There was a hailstorm around here a few years ago, while every vehicle was still fine mechanically there was tons of cosmetic damage. Hundreds of vehicles were written off leaving owners to have to find replacements.

garrhh!!! horrible!! okay well i got some new quotes from a couple more body shops..lowest is 2.7k but might get it knocked down by removing the small scratches to about 2k
now my jeep not sure how much is worth but if its around 2k like 300 more or less would they still write it off?

They may or may not, around here I believe if the damage exceeds a percentage of the cars value( I think its about 80% eg. car is worth 2000 if damage exceeds 1600 its written off).
