http://www.msnbc.msn.com/id/31860742...ime_and_courts
kid kills hiker he "mistook" for a bear while hunting. convicted of 2nd degree murder and gets 30 f ucking days in juvie and essentially three weeks of community service
i've seen people get more time for killing an animal out of season.

Anybody with a brain knows that ain't how it went down, dead men cannot defend themselves, especially when it's one hiker VERSE two brothers, I say the kids got into a confrontation and ended it with deadly force. I mean come on he wasn't hunting bears with a handgun, he was probably using a long gun that was scoped, if you cannot tell a human from a bear iron sights, let alone a scope, you shouldn't be hunting. And hikers usually where pretty out there kind of colors, they're not in full black, or brown. Story just smells fishy.
Why do we even HAVE juvie, you do an adult crime, you go stay with adults, the kid was responsible enough to use a firearm, he was a grown up in my book, 5 years minimum in big boy prison, enough to get scared pissless and recoup some of your life. I love firearms with all my heart, but I hate negligence with them.

no leg to stand on with that statement...
Mistaken identity happens quite often in the woods especially with an inexperienced hunter. You hear somethign and suddenly everything in the woods looks like a bear(or intended game). Clothing color and such may have played a role in this as well.
This should have never happened regardless. Kids hunting priveleges should be stripped for life. Not sure how old his brother was, but the kid should have not been left alone to be making decisions on his own.

"second-degree manslaughter with a firearm" just saying.
i do believe only one month in jail is pretty half arsed tho. He didnt identify his target before firing. and he took another persons life and destroyed many others. he may be sorry for the accident but 1 month in jail in exchange for someones life? no.
i do agree tho that mistaken identity can happen. ive almost ran people over at night because they were walkin on the road and wearing all black...

on the one hand he's just 14 on the other hand HE KILLED A GUY.
30 days? WTF? If it were my dad he killed and got off like that, I don't know how long he would still be enjoying his knee caps after he got out of juvie.

Alright then, well he still was 14, with no adult and if someone who hunts cannot take the time to identify his target he needs to be banned from hunting. Firearms are a responsibility, stories like this will just give fuel to impose more BS regulations of guns and hunting licenses, age to own/hunt etc.

had a friend get more punishment at the same age for stealing TWO cd's. that's right 30$ worth of merchandise is more valuable than another's life.

I agree 100%
Id like to know more about if the kid had been through the proper hunting education class and such.. Adult supervision most likely would have prevented this...

i stood at my living room window watching a father coach his son on shooting out of a moving vehicle at a small group of deer. adult supervision isn't all it's cracked up to be.

very true...
there are some very irresponsible adults out there weilding a weapon and a license to hunt. well sometimes they have a license.. hell if they are going to hunt out of a vehicle on a highway, why have a license right? lol
Makes me quite sick..
the allure of shooting animals, especially antlered deer, is so strong that people will go to great lengths to do it illegally and unsafely.
My buddies dad had a gun held on him when he confronted poachers years ago on their place, all for a deer... Amazing...

no, it's still a felony. the punishment range is a 5yr min for an adult...

In other news, Donte Stallworth finished up his 24 day sentence for his fatal accident stemming from a DUI.

thats one part of the system that really irks the crap out of me... Athletes get special treatment.. I cant count the number of times of an incident like this and they get proven guilty and get a slap on the wrist..
Make an example of someone for something other than dog fighting...

thats absolute bull****.
now i've never been in this situation before, so, im not one to judge... but just how the fck do you confuse a human being for a fcking bear? if you cant tell wtf it is, you probably dont have a good shot and shouldnt be shooting at it anyway.
i agree with rob in that this sounds really fishy. im thinking this old lady had a word with the kids or they had some kinda disagreement and it ended up with her brains all over the woods.

hunters shoot at noises and movement sometimes out of excitement.. its not uncommon to shoot something other than the intended game.. Happens every year every where... I know of a guy who got a face and neck full of turkey shot this year from a very simialr situation.

Never should have happened, I can never understand how someone can mistake anything as it's just so reckless to take a shot at something without 100% ID. I killed my first deer at 8 years old and it's just common sense that you don't shoot unless you have a good shot, and how can you even know that you've got a good shot if you don't know WTF you're shooting? Having said all that, a 14 year old bear hunting in the woods was likely very afraid and I'd be willing to bet fear had a huge factor in his decision to pull the trigger. I can't say I agree with the sentence, but then the jury likely decided the sentence for a reason due to a lot of things presented in court and let's face it 14 years old is very far from being an adult so it's not like a 17 year old minor who's got better judgment.

juvie trials, around here, are non-jury trials.
