My question to leonidas and SCD. Why isn't the death penalty being sought in the mother's case? I am not that far into my Crim Law class yet.

Jurors weep at details of 'Baby Grace' torture

GALVESTON, Texas ? Jurors wept Tuesday watching a woman describe how teaching her 2-year-old daughter proper manners turned into a daylong torture session in which the toddler was beaten with belts, dunked in cold water and flung across a room so violently that she died.

Kimberly Trenor, 20, detailed the abuse in a videotaped statement played for jurors during the first day of her capital murder trial.

Trenor, 20, told investigators in the statement that she hit her daughter with a thick leather belt to teach her to say "please" and "yes, sir."

The little victim was dubbed "Baby Grace" by investigators who worked to identify her decomposed remains after the body was found in a plastic container in October 2007 on a tiny island in Galveston Bay.

Trenor's 25-year-old husband, Royce Zeigler II, is to be tried separately on murder charges. His attorney argues that Trenor is responsible for the child's death.

But Trenor insisted it was her husband who became so enraged when the toddler didn't behave better that he hurled her several times across a room, ultimately fracturing her skull and killing her.

"I said we have to get her to a hospital. (Zeigler) said, 'No we can't. We'll go to jail,'" Trenor said in the videotape, crying. "There came a point where she stopped breathing. He started doing CPR on the floor. He took her ... and handed her over to me. I could just feel her going cold."

At the defense table, Trenor's eyes teared up as she watched the videotape on a large screen. Several jurors wiped away tears.

Riley Ann Sawyers tried to stop her mother and stepfather from beating her to death by reaching out to her mother and saying, "I love you," assistant district attorney Kayla Allen told jurors earlier in the day during her opening statement.

The toddler's pleas didn't stop her mother from brutalizing her, the prosecutor said.

Allen said that on July 25, 2007, Trenor and Zeigler disciplined Riley by whipping her with a belt, pushing her head against a pillow and holding her head under water. She said Zeigler tossed Riley across the room, fracturing her skull. An autopsy concluded the fractures caused her death.

Allen said the adults did nothing to help even as Riley lay dying.

Instead, the couple bought a plastic container, stuffed Riley's body inside and stored it in a shed for a month or two before setting it out to sea, the prosecutor said.

Defense attorney Tommy Stickler Jr. told the jury that Trenor never intended to kill her daughter and that things just "spun out of control."

Stickler portrayed Trenor as a scared 19-year-old girl who had moved to Texas from Ohio to marry a man she met while playing an online game. She said Riley's father, her former boyfriend, had assaulted her and Zeigler was her "knight in shining armor."

"I don't want to use the word accident, but this wasn't something that was intentional," Stickler said.

Trenor could receive an automatic sentence of life in prison without parole if convicted of capital murder. The jury could also convict her of a lesser charge.

Prosecutors declined to seek the death penalty because they didn't think they could prove that either one would be a future danger, as required.

I think the death penalty is reserved for the premeditated type murders - where they were planned and the offender had every intention of killing someone. I think the defense could argue against that here.

Having said that, I hope these two are brutally gang-r*ped on daily basis in prison for the next 60+ years. I've heard that child abusers are not treated well in prison by the general population so they have a lifetime of solitude and/or violent beatings ahead of them. Nothing close to what they deserve, imho. Tragic.

OMG. This is awful. I was saying the other day that people should have to qualify to have children. I saw something about a couple losing their jobs and killing their 5 children and then themselves. WTF is wrong with people? So many people want kids and don't/can't have them, and then there are sick, sick bastards like these turds in skin that do this crap. Sickening. Too bad there is not an "eye for an eye" penalty.

I read that but I was looking for a more formal legal oir statutory reasoning (if there was one).

The Baby Grace and Caylee Anthony stories have really caused me pain. I cannot fathom how someone could do those things to their child. No matter how angry I might get at my kids I would never do anything to cause them harm. People like this deserve death and worse.

I've always thought that peole who hurt children should be held to the harshest of punishments and after being a father for almost 6 years, that feeling grows stronger each day. I just dont know how anyone could treat a child that way. No punishment will ever be enough for what they did. Beating and torturing them, the same actions they are guilty of, would be a good start tho.

Not wanting to log into Westlaw so this is just a guess.

More than likely one of statutory requirements of this jurisdiction in dealing with the death penalty is to prove that the defendants are capable of doing this again.

My first thought when reading this is the Mens Rea. This would be hard to prove as premeditated and therefore almost impossible to get the death penalty.

This was a huge deal around here when the news first broke. This was when the first person had stumbled upon the container that Baby Grace had been put in before being tossed.

It's disgusting, it's infuriating and they both need to be kept alive and reminded every day that while they live, their daughter doesn't get that luxury. They should be shown a video of what they did to that child every morning when they wake up and every night.

Killing them with a chemical cocktail seems too gracious. Let the general prison population have their way with them eventually. Have the guards "become preoccupied".

its crazy that low IQ families average almost 5 kids and high iq families average 1.5 kids. in many ways this is dragging us down

I just found this story also which is extremely sad and disturbing.



A Los Angeles man who was fired from job at a local hospital killed his five children, wife and himself at their home yesterday (January 28).

According to CNN, Ervin Lupoe, 40, decided to take the lives of his family after he and his wife were recently fired from Kaiser Permanente Los Angeles Medical Center.

Prior to the killings and his suicide, Lupoe sent a note to a local TV station threatening to kill his family and himself because of an employment situation. He would also call 911 and tell an operator that his family was dead before killing himself.

Lupoe shot his wife and five children then shot himself. The children were an 8-year-old girl, twin 5-year-old girls and twin 2-year-old boys.

A suicide note was found at the home. Lupoe wrote "after a horrendous ordeal my wife felt it better to end our lives" and "why leave our children in someone else?s hands?"

Usually this or there is some other special aggravator that must be proven in order to receive death. Each state is different in regards to what crimes qualify for the death penalty, so it is just a guess.

My favorite movie since the day I've seen it was Boondock Saints. For all those who don't know, it's 2 brothers who decide to go around and kill the evil people in the world. Honestly, I loved that movie because that's what we need sometimes. If a person or group of people were to go find these people or kill them in jail, I believe more people would be happy then sad. Two wrongs does not make a right. Killing them as they killed their child makes us just as guilty? Fuk that. These people are obviously fuking out of their minds and need to be fuking punished.

Absolutely. I am what is normally considered to be "liberal" (mostly because I want God out of politics) but if I were in emperor I would make temporary sterilization mandatory if a person is giving government benefits in the form of AFDC, Section 8 housing, etc.. The stupid are definitely outbreeding the intelligent and sucking up a disproportionate share of resources.

I am with ya. Today on the Chronicle a headline said Baby Grace said "I love you" during the ordeal. This really brought tears to my eyes as I have 3 childeren. I can't imagine what type of person would do this. Hopefully, prison justice will prevail. If you catch my drift.
