Calling out Muscletech/Iovate - sueing bb.com members (serious)

FYI Iovate/Muscletech/Multi Formulations etc. is currently using a smoke screen lawsuits claiming patent infringement on the following companies.

1. Black China Labs - Case Number 1:2008cv00808
2. Millennium Sport Technologies - Case Number 1:2008cv00809
3. Nimbus Nutrition - 1:2008cv00854
4. USP Labs - 1:2008cv00852
5. Beast Nutrition - 1:2008cv00890
6. IForce Nutrition - 1:2008cv00894
Possibly more since 10/31/08

Iovate is not only going after the owners of companies but reps for the named companies even when the reps are not actual employees. It is apparent Iovate is tired of people talking negatively about their products, marketing tactics and forum behavior right here on bb.com. They have sent summons out and are trying to strong arm anyone that critiques their products in a not so positive light. This behavior put Iovate on the same class as Syntrax for myself. If you also notice Iovate whom is a very large corporation has singled out the somewhat smaller companies out there to flex their legal muscle. I find it outlandish that Iovate's legal team feals they have the ability to sue non-employee's for patent infringement. So Iovate why would you create frivolous lawsuits? Do you or your legal team understand the penalties that can become when this is proven in a court of law? It would be wise for you to drop all cases, give us a public apology and pay for all legal fee's associated with the cases.

The wording in your legal documents are interesting but keep in mind saying we are representatives is because we are following rules of bb.com

Companies and company representatives must list their affiliation in their signatures. Affiliation includes but is not limited to Company name, home page url, and email addresses. Other identifying information such as
screen names, telephone numbers, and customer service lines are optional. Company representatives who do not list their affiliation in their signature are subject to banning and possible loss of posting privileges for the ENTIRE
company in question.

This does not make us employees. W-2 holders or receive monetary compensation for what we do. Many of us represent companies because we believe in the products and what the company stands for. So in summary Iovate is punishing the companies we represent to defend posts we make here that Iovate approves of. This costs small companies substantial
money. Ex. Local counsel wherever the supp company is, the New York counsel, the patent counsel etc. Even if they drop the case it costs these supp companies thousands.

i love this post, i hate muscletech and all the company's they own there products are always crap and way over priced, then when they release I feel sorry for all the suckers who really think they make products that will make you look like the worst mr. O of all time
