SAN FRANCISCO — A federal judge on Tuesday blocked a Trump administration order to withhold funding from communities that limit cooperation with U.S. immigration authorities, saying the president has no authority to attach new conditions to federal spending.

U.S. District Judge William Orrick issued the temporary ruling in a lawsuit against the executive order targeting so-called sanctuary cities. The decision will stay in place while the lawsuit works its way through court.

Ugh no Sherlock, Seattle isn't saying and can't say that ICE can't function in Seattle.

"Sanctuary cities" mean Seattle Police Department, resources, officials, and officers will not cooperate with Fed/ICE.

There is nothing constitutionally resolved that says the FEDS can take resources/money away from Seattle as a result of that lack of cooperation.

Generally, the precedent here is the Civil Rights Movement when southern States/locales refused to abide by Federal Law concerning integration. The Feds still had jurisdiction for supremacy and used it sending in the Army and National Guard, but could not use that to take Federal money from going to those cities.

If there is one thing I learned on this forum since Trump phenomenon, it's that the overwhelming majority of Americans are extremely ignorant about the law/constitution.

Seattle isn't asking for charity anyways. Seattle, San Francisco, other sanctuary cities pay more in federal taxes than they get out of it. It's like giving a person a $1 as part of a trust and he is refusing to give you the 0.80 cents you are entitled which you accepted while not even contesting the disparity of receiving less than you paid into.

Maybe Seattle should stop paying taxes to the Feds until Trump is kicked out just so we can see how the piss poor, Republican counties like not being subsidized instead of asking everyone to share their bigotry.

You misunderstand our devolution of our powers, classes of laws, and who is compelled to be responsible for what within established constitutional law.

Immigration is entirely within the jurisdiction of the FEDERAL government. Cities and states CANNOT interfere, "deport" people, or take immigration in to their own hands. Hence the Obama administration successfully suing Arizona's immigration law. Because of this reason, on the other side, Seattle CANNOT prevent ICE from working in and deporting people from Seattle

it is entirely within Federal jurisdiction.

As a result, neither Seattle nor Birmingham, Alabama is compelled to work with or not work with the FEDS. They can do so at their own discretion, even though both are forbidden from taking the issue into their own hands and giving mandates to ICE/FEDS (setting their own immigration like complete amnesty or deporting).

That's different than civil and criminal law where EVERY JURISDICTION from Federal to State to County to City is responsible for carrying out, i.e. marriage, hate crimes laws.

So Seattle has basically said we don't want to work with the Feds on immigration, because we DON'T have to. But conversely, Birmingham, Alabama cannot say we won't issue gay marriage licenses because they have to. They are mandated by law to provide this service; Seattle is not mandated by law to do anything about immigration.

At the end of the day it's a mandate that really isn't the feds decision. Or shouldn't be. It's comes down to how the resources are managed
