I'm not a lawyer, but...
So many supplements put a little disclaimer on the side - "These statements have not been evaluated by the FDA", and use language like "may improve your strength" instead of "will improve your strength", that way they're not actually making any direct claims. They also almost always say, "in conjunction with a proper diet and training programme".. so basically, they absolve themselves of any responsibility for 0 effect.
If you can do that, and do a big of trialling first to make sure there's no adverse reactions, you should be OK. Of course, if you're creating your own new types of compound and not just mixing naturally available ingredients, you might want to be more stringent with the testing and there may be some laws that apply before you can call it edible.
Best bet would be to ring the FDA and ask.

It seems that in the US you can get started with some bulk powders, a cap'm quick, labels, bottles, a website and an empty garage.
