I'm not a lawyer and I live in Aus not US but I think you'll find that while threatening to bust her windows may have been an offense, the actual busting of the windows would not have been an offense, because technicaly she gave you permission to do that. Thats sounds silly but the law is like that.

I don't think you're in too bad a situation legally (with a good lawyer). Personally I think you should try to keep it that way if the husband shows up.
Keep the law on your side with your actions.

If he is coming to attack you on your property you probably have the right to evict him with reasonable force (you do in Aus) and right to self defence. Again work with the law not against it.

The law is funny like that, I was watching Judge Judy and a guy there was telling a story about how he was charged for reckless endangerment when he had a gun pointed at his face, he push the gun away from him and the gun fired and hit another guy in the neck.

How the hell was he the one charged for reckless endangerment? He was defending himself

It is illegal to park in front of a driveway, correct? The point about the gate being open or not is inconsequential. You should have spent your extra effort going and having a sign made that states so and that vehicles will be towed. Now you may end up having a rock thrown through your auto or house window in a drive-by, putting others at risk besides yourself.

As most of you know I work from home so my car is always in my garage or driveway. I live across the street from a public school and at 8:00 am and 3:00 PM there are always a bunch of cars parked in front of the school but most respect all the privately own houses across the street from the school. (Meaning they do not block the driveway if they notice the gates are open)

Well today I go back to an audio place (I had a new radio installed in my car yesterday and there was something wrong with it) and when I came back there was an SUV blocking my driveway.

I was a little upset but figure this is a first so no big deal I will wait till he/she comes out of the school with his/her child.

I waited for about 15 minutes not bad had my drop top down and was listening to my new system (which is off the hook by the way)

So here she comes with no kid now, so she wasn't in the school. So I said to her (in these EXACT words as many here always say, maybe there is more to the story bull****)

"Ma-am please do not block my driveway, if you see the gate open that means the person is coming right back"

Well she went off the deep end cursing me out, telling me who the F'ck I thought I was telling her were she could and could not park her car, and that if she wants to park her car there that she will when ever she damn well pleases. Keep in mind she was parked right in front of my driveway. She starts getting in her car.

So I told her if you park your car in front of my driveway again I will have you towed.

She gets out of her car starts coming towards me cursing at me again, saying if I have her tow she will get her husband to deal with me, all the while putting her finger in my face.

Well me being me I lost it and I told her the next time you park your car in my driveway I will bust all your Fcking windows!!

She started yelling, let me see you bust my windows I F'cking dare you, go ahead I dare"

So I went in my garage came out with a crow bar and busted two of her F'cking windows!!!.

She jumped in her car and said she was coming back with her husband, that was 2.5 hours ago I am still waiting..

Manners costs nothing. Everything would have worked out just fine if she approached you with the right attitude.

Makes me think of the time my lard ass neighbour decided to build a two foot wall on the pavement which he extended to about 2 meters in front of my home. I made enquires as to what was going on and asked him to remove the structure from in front of my property.

Nothing happened. A week later it still sat there.

That Saturday he was standing outside on the street drinking beer with all his mates. I came out with a sledgehammer and broke the wall down. They went silent. Just looked at me, said nothing, did nothing. I guess he could see that I was annoyed.

I mangled it real good & then threw all the broken bricks onto his side of the road and went back inside.

Never heard anything from him.

Needless to say, we’re not on speaking terms.

Sometimes people do something deliberately and turning the other cheek doesn’t resolve the problem. It in fact encourages further abuse.

There is definitely a time to stand up when you’re a man. Personally I think that this was that time.

Here's the thing BH, I usually agree with your approach I think when provoked, occassional violent outburts are a viable remedy.

But this lady was in front of your house, dropping her kid off....

She knows where you live and goes by there everyday. Im not saying she was right, but you now have a long term issue because concievably she will be coming to your area every school day (or her husband).

Not trying to attack John, but this is, IMHO, 100% unacceptable behavior from any human, let alone a man in his 40s with a house, job, and family to take care of.

I agree that BH acted in a manner that is not to be applauded, but I do not think making a new account to berate him is really something a REAL MAN would do... or woman for that matter.
