Whey protein is perfectly fine. It does not cause fat gain. Excess calories cause fat gain. There were some RTD's (ready to drink liquid shakes) that were evaluated and showed high metal content. However, the tests were flawed (the amount that they tested was more than what the drink itself recommended) and the metals that they found in those drinks are very common in MANY of the foods that we eat everyday.

I don't think the FDA approves protein powders, let alone approve individual ones. I'm fairly sure that the FDA just approves foods and drugs (say ... they should name it something like that, food and drugs approver or something ...). So they would, for example, approve or put out a warning against whey protein in general.
However, I'm not sure whether whey protein is classified as a "supplement" or not, legally. If it is, then it is not in any way regulated by the FDA, nor are the companies that make it. It would be the FCC that regulates them in the case of making false or misleading claims.
